hello everyone,
my family and I appeared before the tribunal few weeks ago, and our asylum claim was refused because of many inconsistencies, to use the judge's word.
can we apply through Humanitarian ground, once our written decision is received?
or are we going to be sent back home with no opportunity to appeal or reapply through Humanitarian?
if using humanitarrian, what would be our premises? lastly, while still going through all of this, can I possibly get a study permit to do my MSc?

You cannot apply for H&C within one year of receiving a negative decision on a refugee case unless you meet one of the exceptions (have children under 18 or suffer from a life-threatening illness). Also note that you cannot apply for H&C from outside of Canada.

The chances of a study permit being approved are close to zero with a refused refugee application.

Your best option is likely to appeal your refugee case if you feel the decision was incorrect.
 
Thank you very much for your prompt response. Truth be told, I don't feel the judge's decision was incorrect. Like many people that crossed US\Canada Borders, the story wasnt truly well grounded or concocted if you like. This is the reason am a bit sceptical appealing it, except if it is possible to appeal to buy more time? Also, our two kids are under 10years, schooling in Montreal. |Does that qualify me for H&C? or I still have to stay for a year to use H&C?

You can apply for H&C since you have minor children. However understand that H&C approval rates are quite low. Based on the info you've provided so far, you're most likely looking at another refusal. So most likely, all you'll be doing is delaying your departure from Canada by a number of months.
 
Although I am happy to hear people being honest that you are defrauding the asylum system you can understand why many Canadians are angry at asylum seekers in general because there are many, like your family, who will cost Canadian taxpayers 100K.

So you didn't concoct a good enough lie. As said above, people like you are the reason why Canadians have so much anger for those genuinely in need of protection in Canada.
