I USED AN IMMIGRATION LAWYER, i GOT A FILE#AND PAID $2000 FOR THAT SKILLED WORKER CATEGORY AS ACCOUNTANT,BUT ON JUNE 28, 2010 I GOT THE REFUSAL LETTER STATING THAT I HAVE NOT COMPLETED THE 1 YEAR WORK EXPERIENCE AS ACCOUNTANT BUT ON MY CERTIFICATION WAS CLEARLY STATED THAT MY EXPERIENCE IS FROM 2003 TO PRESENT.AND MY CONSULTANT TOLD ME THAT THE REASON OF MY REFUSAL IS BECAUSE WE MOVED TO ANOTHER OFFICE WHICH I INFORMED HIM.CAN i STILL APPEAL MY CASE?PLS.HELP..... :)
 
have you worked from 2003 till present on the same position for the same company? who refused you...CIO Nova Scotia or your country visa office? give more details.
 
Sorry to hear about your refusal pal, it i don't know if you have a chance to appeal , your lawyer should be able to tell you exactly what to do to appeal and as soon as possible , but i have a question how come on the first stage of your application you had already paid the whole 2000 $ ? i thought people usually pay lawyer gradually as the the application moves step after step, Anyway i hope he/she will pay you back now because your application was unsuccessful.

yes. I am still working at the same company but the only reason was move to a new office,cio sydney,nova scotia name is s. erlichman.please help me

He told me that there's no way to appeal since finance/accountant was removed from occupational list.but on my point of view it just a matter of missed reading the application were in it was clearly stated that I worked on that position for 7years.actually the total amount i have already paid to my consultant is $7500+.that's why if you could help me and if there is way to appeal my case.is it ok if I will do the appeal?

dam brother - thats a very big amount feel sorry for you. still try to explain your position to CIC as your rejection was made on wrong basis.

Gud lord...besides the refusal issue which is really shocking, 7500 dollars is huge. I paid CAD 1500 only for whole process ???

God give you courage and way out

Did the documents make it to the Visa Office or were you refused at CIO stage? I assume since they haven't processed post-June 26th applications yet that this must have been at the 120 day stage at Visa Office?

In which case I believe you can appeal.

If applications are refused at CIO stage then you have to make a fresh application, if they are refused at VO stage then you have right of appeal and your application will count from the date you originally replied.

That's my understanding anyway,

This is really a sorry case. I now see why cic is clamping down on some consultants. 7500 dollars for what? am sure he has promise you that he will get the visa for you. i would advise you take him to court, print his name on the forum so that no one does business with him again and if possible report him to cic. meanwhile post exact words they wrote on this forum and also give us more information. when did you apply? when did it get to cic? was the refusal from cic sydney or from manilla visa office? how long have you worked as an accountant? do you have evidence to show you have worked more than one year? what are the duties you wrote can you upload them here so we can review and know if you have a strong case?

These and many more will help us advise you better and if possible invite qorax, pmm, leon, rocky and other seniors to help out. Also please dont rush to apply any other category or hire a new consultants for now lets first see where the mistake was, address it and plan a way forward. My dear dont be too discouraged when there is a will there will be a way

Let me understand, you applied on April 2010 for FSW as an accountant, job which existed before June 26th in the 38 list. You have more than an year experience. At that stage you shouldn't have to provide proof of your work experience...you only have to fill in the application forms, you do not have to attach anything at that stage, the work experience must be shown after you get the approval from Nova Scotia, at your Visa Office.

I feel sorry for you , as my reprensative is it self David Cohen one of the top immigration lawyer in canada he charged me about USD 1,995
so you numberss are so far away from this figure ,,,you better report CIC and also lauch a FIR againts your reprensentative if he dont refund your full amount .....

I applied on that category on August 2009 and it was approved I even got my File # January 2010,at the final stage every thing was alright even my show money and the other documents he ask,the certification from my employer which is clearly stated that I haven worked from 2003 to present but when I received the letter from my the embassy through my consultant it was stated that I don't have a continuous work experience on that field.I will upload my certification and the refusal letter and please advise me if i can still appeal. how to upload my certification and refusal?
