Hi There,

I have been reading this forum for a little while now and it has been very helpful. A bit of background, I applied for a study permit for myself (40 yrs old) and my daughter (14 yrs old) as well as OWP for my partner and adult dependent son (He's 22 and has special educational needs as well as an EHCP documenting this, so hopefully will qualify as a type c dependant) on 16th May 2021. We completed our biometrics on 9th June 2021 and these were marked as received the same day for myself and partner and 28th June for my daughter and son.

I received approval of my study permit on 23rd June as well as confirmation of eTA and BVL (yes, very quick and I am exceptionally grateful as I know many have applied much earlier than me and still haven't heard anything!) my application didn't show progress of any steps in between and still shows as awaiting a final decision. My partner's eligibilty status changed to "we are reviewing your eligibility", on or around the 26th June, unfortunately we have had no further update on any of the other applications and I am starting to get a bit worried as I still need to book quarantine hotels etc.. We have flights arranged for 5th August so are getting pretty close to the wire now!

I sent a webform to the London office on Friday querying if they were able to give any update on the applications and am hoping to hear back soon.

As a back up plan, I wondered if I could just apply for eTA's for them whilst we await a decision, we are UK citizens so do not need visas to fly, but I'm worried that my family may be turned away at the other end if they have a separate application in progress or that the eTA application may intefere with their applications somehow, my partner has a criminal record but meets the criteria for Deemed Rehabilition. I am able to support my family financially as I have been lucky enough to arrange some remote self employment through my current employer in the UK, which will fund my studies and at a stretch my family, if necessary, we also have funds of around 50k CAD If needed.

Does anyone have any idea, if this is ok to do? What do I need to be wary of?

Any help or advice would be much appreciated, thanks for reading :)

Your case might be a little complex. In my case, I applied for a SP and SOWP for my wife. I received PPR and her PPR arrived a month later. Maybe it'll be your case too.

My comments:
- There are a lot of moving parts here.
- I'm not sure I see the eTAs is being feasible for an August 5th arrival. Your family can certainly apply for eTAs. However right now Canada is not open to tourism so they would either need to obtain written authorization to travel from IRCC (needed to board a plane) which you are very short on time to do, or alternatively, they would need to travel once travel restrictions relax on or after September 7th.
- I assume you've applied for something other than an OWP for your son. Your wife is the only one who qualifies for an OWP to the best of my knowledge.
- It was probably always a given that your partner's part of the application was going to take longer to process than normal due to the criminal record. This basically means the application is non-standard because IRCC needs to review the details related to the record, assess admissibility, etc.. If your spouse applies for an eTA, expect processing times won't be normal there either for the same reason.
- Be aware that even when someone is technically deemed rehabilitated, depending on the nature of the offence and how long ago it occurred, we still sometimes see IRCC require people to go through the rehab process. Hopefully what your spouse has is very minor.
