Express Entry CRS: 459

So I received an offer from a company in Ottawa 2 weeks back. I am currently based in India and law firm has taken all my documents and would soon start the LMIA process which would eventually go to work permit. I have a valid express entry profile with CRS 459. I was reading through the OINP website about the category "Employer Job Offer: Foreign Worker Stream" and it seems to me I can do it after LMIA approval (as part of employer requirements). I am thinking of this option as there have been no tech draws so far since April.

So my question is can I apply for this stream myself or employer has to do it (since it has employer requirements too).

This position in Canada is in-line with my 7 years of experience and my master's. I fall in NOC Skill A under NOC code 2147. I also looked at the median salary for my NOC in Ottawa which is around 50 CAD/hour and maximum one being in 70 CAD/hour. I calculated my hourly pay based on CIC instructions: 160,000/52 = 3076 per week or 3076/40 =
76.9 CAD per hour.

You have to apply for this stream yourself (or via a rep), starting with an expression of interest. The requirements for your employer are mainly about its capacity and its size of doing business which is reviewed whether it can afford and urgently needs you. (no worry. I am sure it can!) When OINP processes your application, they may contact your employer to verify your employment.

Thank you. But can I apply for it before receiving LMIA? For employee, it doesn't mention anything and I think offer letter should be good enough. But when I check employer requirements, the employer must have positive LMIA.

I started with Expression of Interest but got little confused and didn't go any further. So CIC would directly contact the employer, right? I just need to apply. I was bit hesitant so that it doesn't effect my work permit or PR process. Since tech draws are not in sight, I thought this might be better way.

It's a semiconductor/Telecommunication company. I just looked at jobs on LinkedIn and applied to company's website. Maybe my relevant education and experience helped.
 
The main answer to your question is yes - you can use this role to apply for the OINP Employer Job Offer - Foreign Worker stream. It's changed this year so you need to submit an EOI first and they draw from the pool, then you submit your application and if approved, submit a paper based application for PR. There are some additional requirements on work experience which you will need to fulfill as well.

The long answer is while you're eligible, there may be better pathways for you available. Having an LMIA will grant you an additional 50 points - you would be competitive in the Express Entry draws once they resume for FSW, and even more competitive once you have 13 months work experience in Canada. The timeline for Express Entry is far simpler and easier, if you can get an invite.

The timeline for PNP right now for example is that many of us have submitted applications in as early as September last year and are still waiting for the department to acknowledge them. Express Entry applications on the other hand can be processed in as little as 12 weeks in some cases, but typically they are finalising applications from earlier this year.

I would suggest preparing for the Express Entry route if you can, get your education assessed, get a language test, and get your profile in while you wait.

Thank you. Yes i have a valid express entry profile (CRS: 459). Once I have LMIA, in the next draw I would be picked for sure as my CRS would be 500+. But since there are no draws and no information when would they resume (later this year, next year) so I thought PNP is better route.
I thought PNP was faster. Like many people who got NOI from tech draw of April 13, I was seeing they got PNP in 2 to 3 months.

Actually I also missed last tech draw by matter of hours (my profile was in only on April 14/15) and there is no tech draw since then, which is kind of weird seeing last 1 or 2 year pattern.
