Hi everyone,

I’m looking for some guidance from people who have gone through a similar situation.

My refugee claim was refused by the RPD, and then I appealed to the RAD. The RAD recently set aside the refusal and sent my case back to the RPD for reconsideration. I received a letter confirming that my file has been returned to the RPD with instructions for a new decision or a new hearing.

I have a few questions for anyone who has experienced this:
  1. How long did it take after the RAD return for you to get an update from the RPD?
  2. Did your case get approved without a hearing, or did they schedule a new hearing?
  3. If there was a hearing, was it a full hearing or a short / focused hearing (like only on IFA or one issue)?
  4. How long did it take to receive the final decision after the hearing?
  5. Were there any extra documents or steps you had to send after the RAD returned your file?
I’m just trying to get an idea of what to expect with the timeline and the process based on real experiences.
Any advice or experiences would be really appreciated.

Consider yourself lucky to have another hearing you can convince them the unclear points of your case.
1- It could be up to 12 months
2- You will have hearing, believe me its better for you.
3- It would be short hearing, and with probably new judge (here you have a chance to convince and clear things to make negative decision turns to positive)
4- Up to 2 months
5- You can add extra documents to convince (i mean where the judge objects in rejection letter)
