Hi,

My (Australian) girlfriend and I are currently in the process of filling out our common law sponsorship PR application. I am a Canadian citizen and we have been living together here in Canada for the past 2.5 years. We are going to apply the outland route. Our plan was to move to Australia together in December and apply from there, but she was just approved yesterday for another 15 months of work visa... long story. So now, we will stay for the remainder of her visa, and apply for PR during that time. Since we have already booked our flights, we are still planning to go to Australia for a month or so just for a visit.

So my questions are:

1) How should we submit the application? From Canada or from Australia? Do we send the application by mail if we apply from Australia?

2) I read on this site that you can choose where the application gets processed. How can we choose?

3) Since she is on a work visa, will this affect the outside Canada application? Does she need to be on visitor status?

You can send the application from Australia or from Canada, it won't matter. You can send it by mail or by courier.

You cannot choose where the application will be processed. CIC will decide based on her nationality and her country of residence.

She does not need to have visitor status to apply outland.
