Hey guys,

I am thinking ahead and trying to figure out how to go about..if you can help me. I will be visiting my husband while PR is in process. I am from US so its a visa exempt country. I have a baby with him and also more children from my previous marriage (who are with my exhusband in the States and not accompanying me).

After 6 months (unless I get a VR) I need to have an extention if I want to stay in Canada.

In the applicaiton form they ask about family info (IMM 1249 http://www.cic.gc.ca/english/pdf/kits/forms/IMM1249E.PDF):

Do I need to put

1)My Canadian husband?
2)Our daughter who was born in the States but Canadian citizenship certificate is in process?
3)My unaccompanying children from previous marriage?

One more question..

In Question 13 : have you or any family members in Canada ever been convicted of or charged with a crime or offence in any country?

If my Canadian husband has a criminal history then do I still have to write them down? And how will that affect my application? I have no criminal history whatsoever.

Please tell me anything that you can to help me prepare my extention. I want to be fully prepared.

1) For the purposes of this question, your Canadian husband is not a "family member".
2) Your daughter is not yet a Canadian citizen, so I think she must be included.
3) Your other children are definitely "family members".

See (1) above. Your Canadian husband is not a "family member". This is all my opinion based on reading a lot of posts here. Does anyone else agree?
 
I just received my re-extension of my Visitors Record in the mail today :D :D ;D

NO your Husband is not classed as a "family member" as he is not applying for a temporary status. But your daughter definitely needs to be included as she does not yet have a legal permanent status in Canada!

Q13. I would say "Not Applicable" as it is you and your children that are being assessed in this process to evaluate if you are a threat to Canada..
 
Thanks for the replies!! So I don't need to put my Canadian husband as a family member but my daughter who is waiting for her citizenship certificate (in process according to Ecas) needs to be included.

I know it may sound stupid but will our baby (who is in process for her Canadian citizenship certificate) have to apply for an extention as well? I am hoping that she won't have to. Thanks!!
