Hi,

I am applying for permanent residence in Canada through the common-law partner sponsorship program through the outland process. I am from Spain, but have spent the last year and a bit in Canada living with my girlfriend. First with a working holiday visa, then with a visitor’s visa. I have been back to Spain just for some days, but have spent most of the past year in Canada. On the forms where it says to fill in your current residence I am not sure whether to put Canada, because I have been living here and to show I have been with my common-law partner. Or Spain because I am currently a visitor in Canada and am applying through the outland process. Also, I will be going back to Spain for the end of December/January to visit, during which time I will be submitting my application. Any advice on which country to put as my current address?

Also, I have read that there are 8 pictures (which meet the specific immigration requirements) that are necessary to include with the application. But I have also been told that there are only 6 pictures required. I may have my application rejected if I include too few or too many. Does anyone know how many of these pictures you are supposed to include.

Hi

You are allowed to use a Canadian address even if you are applying outland. If you are only going back to Spain to visit for a few weeks, then put the Canadian address. If you are going to stay in Spain for an extended amount of time, then put the Spanish address and when you return to Canada, change your address to the Canadian one.

I know that I can still put a Canadian address even applying outland. But my question is because whenever I come back to Canada in January2014, (so I am going to stay 1 month aprox.), I am going to be a Visitor, and also, one of the requirements to apply is that if you are in another country than your citizenship you have to send them the visa. So, can I be resident in Canada being a visitor? How can I show that, with the stamp from the passport?

The reason for not applying now is because I have everything ready but the translations of my birth certificate and police record from Spain.

The guide states: Your country of residence is the country in which you are residing, provided that you have been lawfully admitted to that country

It doesn't require that you be admitted to that country on a specific type of visa or for a minimum length of time. If you are legally admitted to Canada as a visitor, you can consider yourself resident in Canada. Showing the passport stamp is fine.

There have been others on the forum who have applied while on visitor status in Canada, using their Canadian address, with no issues.

Can I know where do you find all this information? I was trying to find the definition of "Residence", but I couldn't. Probably I wasn't looking hard enough
