So we and my wife are in a little bit of a pickle here and are unsure how to proceed with our situation.
After getting married, my wife changed her family name to mine. However, it was only updated within the marriage certificate and local registry. She still had to request a new passport with her new family name.
I asked CIC if it was OK to submit the application with her old passport maiden name, and they said no problem! Her medical records were also done under her old passport and CIC said it would be no problem, as long as we update them with her new passport once it's ready.
Now here's the catch.. We went yesterday to get her passport renewed. In Brazil, it's the Federal Police who handles it. You basically have to book an appointment with them, bring your old passport, and request the new one. Then they take about a week to produce the new one and then you have to come pick it up when it's ready. When we came, they took her old passport and stamped it with "Cancelled" but she got to keep it. They actually suggested she burns it...
Anyways, we still didn't submit the application and now are unsure if we can proceed with the annulled passport!
Should we wait for the new one? The forms are all with her maiden name and we were ready to print them tonight when it hit us like a brick wall that her passport is now cancelled, not valid, and we are not sure if we can submit with such a passport.
It's a problem for us to wait for her new passport, because I'm leaving back to Canada next week before her passport is suppose to be ready and we cannot print form IMM008 yet as it asks for the passport number. We won't know it until she receives it. She also needs to sign the document. She would then have to mail me this form which would take time away from us applying. We were planning to have this ready before I leave with everything signed and I would submit as soon as I arrive back to Canada.
So the ultimate question for us now is can we submit the application with her annulled passport, with an explanation on a sheet on paper that she's suppose to receive the new one very soon? We're paranoid because on the form it asks if she has a valid passport, which it is not anymore! Doh us! Please help!
