Hi guys thanks so much for taking the time to read this.

We are UK citizens currently going through the process to apply for PR in Canada.
My husband is applying under the express entry as a skilled worker with his Mechanical engineering degree. He is booked for the IELTS this week.

I am going to be named on his visa obviously as his wife along with our two young children.

Forgive the length of this post but here's the detail:

Our only concern right now is that I was arrested and few years ago (I don't remember exactly but I think it was 2008 ) and released after questioning with no charge/fine or caution. It was a horrid situation where my recent ex boyfriend of the time had accused me of stealing money that was to be donated to a local charity. The police called me and asked me to go in to be questioned which I did. I returned a week later with evidence of him abusing and harassing me, the issue was a cheque which hadn't been cashed by the charity which was then resolved and no further action was taken as they could see the abuse he had been giving me and could see I had not committed any crime. I have never before, and never since had any contact with the police.

I have been losing sleep thinking about this and if it is going to affect our application for PR.
Is there anybody with any advice or a contact I can speak to to resolve my anxiety before we go Any further along with the process? I have nightmares of getting to Canada and being told to go back to UK and we'll be left with no home for our family and no jobs.

Thanks for reading, I really appreciate any advice on this issue.
Nic

As long as there was no charge or caution - you'll be fine.

As for anyone you can speak to - your only option would be to hire an immigration lawyer to discuss your case.

FYI - If someone did have a criminality issue that affects PR, they would be refused during the application process and would never get to the point of arriving in Canada.

Thank you scylla I appreciate the reply. It's taking over my life right now and driving me crazy!

That doesn't sound like you were arrested, it sounds like they simply asked you to voluntarily come and answer some questions (unless there's some parts you're leaving out).

Being arrested usually entails being handcuffed, detained, read your rights, and processed as an arrest.

Genuinely I've always been confused about why and how it happened!
They called me and asked me to go down to the police station. The officer then told me they were arresting me on suspicion of fraud and read me the rights. No handcuffs etc it was all very civil. I was then questioned and they let me go a couple of hours later.
I returned a week later with some evidence and then a further week later they called me to say I didn't have to go back.
