Hello,

I came to Canada (Montreal, QC) under a visitor's status back in the end of August to see my fiance for the holidays. We decided we wanted to have a wedding October 30th. We got married, we have the marriage documents from the provincial govt signed and stamped. I decided i wanted to stay here with my husband to live, so i got the information on becoming a PR by spouse sponsorship. I submitted my fingerprints to the FBI and i know i can't submit my sponsorship application until i receive that police certificate, correct? (i already know i need the medical exam and photos also but those can be done at any time)
It's been over a month now that i submitted the fingerprints so it's cutting close to my 6 month stay already. Will i need to travel back to the states or do i stay here to wait on the police certificate to come through the mail so i can submit my application? Me and my husband are so confused we have no idea what to do? A little guidance would be so appreciative!!

Hi Trista,

1. Yes, you need to wait for the police certificate(s) before you send in the application.
2. You could leave the country, try to flagpole around the border and hope for the best, or apply for an extension of stay.

I would recommend the extension of stay. It's not expensive, and while you wait for it to be processed you have "implied status" which means you are considered to be legally present while the application is being processed, even if the originally authorized period of stay expires. You do have to apply for it in time, though.

You can do it online or by post, it has to arrive at Vegreville before you current status expires.

If you apply by post, get a signature for the delivery, once CIC have it, you are on implied status.

With family spousal, the photos and the medical section A IMM1017 from needs to be sent with the PR application.
