Hi all,
Criteria no. 2 says:

"You must be currently working in the United States and possess a valid visa in one of the following temporary skilled worker visa categories: H1-B, H1-B1, H-1C, E-3 at the time the AINP makes a final decision on the application"

Does anyone here know if this is a new criteria starting 1/1/09 or if this prior to 1/1/09?

I was applying for pre-assessment in Oct 08, got invitation letter in Nov 08 and sent application in Dec 08. The problem is my H1B is expired in Jan 09 and I'm currently change status to tourist visa. I don't think there was criteria no 2 prior to 1/1/09 but would love to see if anyone here can also tell me if this is true.

sorry if this considered a duplicate post, but, I have read the other post which is under NEW process thread and I'm not sure if it was always like that.

First of all, before I even sent my pre-assessment, I sent email in Sept 08 told them that my H1B will expired in Jan 09 and asking if this going to be an issue and this is the response I got from them: "So long as you apply before your H1B expires, we will continue to process your application."
I also not sure if I read the requirement that we had to currently working at the time the AINP makes a final decision on their web on Sept 08. But, again, I could be wrong, and therefore, asking with anyone who can confirm with me that the OLD process don't have this requirement.

Second of all, on your post, you said that you have to be in the US because you have to process your application in Buffalo. But, according to their requirement, not only we have to be in the US, but also currently working. If we only have to be in the US then there are other possibilities. Someone can be out of their H1B but then change their status to F1, B2, etc.
