Hi all,
I'm planning to apply for EE under FSW. I have a question regarding "at least 1 year of continuous work". I'm in the final year of my PhD in the US on a F-1 visa. I'll be applying under NOC4012 research assistant.
US immigration rule is that F-1 holders may take up on-campus employment up to 20hrs/wk when semester is in session, and "full-time" when semester is off session.
I have been working continuously as a research assistant throughout my PhD. But, if my work experience letter were to state that I worked 20 hrs/wk when semester was on and 40hrs/wk when semester was off, same position/job/duties/everything, would that be considered "discontinuous" because of the change in number of hrs?
When filling out the EE profile, there's only 1 blank for the number of hrs per week, should I put an average then?
-- If so, should I calculate the average using 20hrs/wk and 30hrs/wk, or 20hrs/wk and 40hrs/wk (since CIC states that under FSW "We don’t count any hours you work above 30 hours/week.")
-- If I calculate it based on 20+30, but my letter states 20+40, wouldn't that be confusing?
Honestly, I feel this 20/40 thing is adding too much complication. Would it make sense to advise my boss to simply state 20hrs every week? I have enough years either way. My boss would have no problem saying that I worked 40hrs/wk every week if it were not for the technicality that F-1 cannot get paid for >20 hrs during semester, coz let's face it, everyone knows you can't do a PhD without putting in >40hrs/wk.
Thanks!
P.S. I have done extensive research on applying under NOC4012/FSW for research assistant experience while doing a PhD. It's legit.
