Question on Common law

I have a GF in another province here on a 2 year work visa she has been here 6 months of the two years. She is married to Filipino but apart for 6 or 7 years but no annulment.

Here is the question.

1. If she leaves her job and comes live with me for a year is that considered common law even tho she is legally married in Philippines. At that time can I sponsor her. I am Canadian Citizen.

2. Can she divorce her Filipino Husband from Canada? Can this be done ourselves or will we have to get a lawyer. And can she do this while on her working visa and only in Canada for 6 months.

1) yes, she can be common-law with you after 12 months, even if she is married in the phillipines, only because they do not recognize divorce there.

Im not sure about #2, maybe someone else can be of more help for that one

To answer number 2, i am also on a working visa, i have been living with my Canadian boyfriend for 3 years now, i am married in the Philippines was separated since 2004, and I divorced my husband here in Alberta. We hired a lawyer in Edmonton and it cost us $ 3,400 can. But I know somebody she just bought divorce package from a bookstore and she did all the paper works. Or try to order it online you can google it.

you have to have lived in the province for a full year before you can file for divorce, and you have to be separated for at least 1 year.

yes you can apply as common-law partner

yes you can apply as common law partners..and unfortunately, there's no easy way to get annulment..in my case, i went to my province' Family Court and filed for a simple divorce..just go to to a family court, there's a window or booth there that gives out forms specific to ur case that u have to fill out and u can even ask for a legal advice with one of their Pro bono lawyers. hope this helps
