Hello Everyone,

I need some help regarding my friend's query on her PR renewal.

She came here in Canada in 2008 on dependent PR. She left the country after 6 months and came back in July, 2013.
She completed her time for renewal and applied in June 2015 (for renewal process)
So far she has only 1 query and that was to submit a color copy of her passport.

It has been 1 year and 3 months and she has not got any answer till date.

She tried calling them many times at Hallifax office in Nova Scotia office but could not get any specific information on the application or its status. All they are saying is to wait as there is no time limit for renewal process.

Could anyone please help on how to approach this dilemma?
 
She applied to renew her PR card without meeting the residency obligation - so that's a pretty big problem. When determining whether someone meets the residency obligation - CIC looks at the previous five years before you apply to renew your PR card. If she applied to renew in June 2015 - then she only had around 23 months of residency (rather than the full 24 months required) - the six months from 2008 were too long ago and can't be counted.

Assuming all of the dates you provided are correct, she should be expecting to receive a refusal of her PR card renewal and an order to leave Canada since she is no longer a permanent resident. She will have the opportunity to appeal if she wishes.

I will be back with some more information on this from her. Looks like a problematic case to me.

So I have more information for the same issue. (I just realized this is a longer text so please stay with me and ask if something is unclear)

She got her dependent PR in June 2008. She lived for 6 months and went back home.
Then She came back to Canada in Jun/Jul 2013. Immigration officer on Toronto Airport asked all the question on why she was not able to complete her time on PR in Canada and why she had to live outside Canada.
She Explained all the reasons and had to live outside of Canada because of Study etc.
So Immigration officer agreed to let her in on a condition that she will have to complete her time period in order to stay PR.
By this time, her PR was about to expire (not sure how much time was left, but approximately 2 or 3 months)

She was issued her Health Card, registered for PEBC examination, working on Salary, Salary getting deposited to her account, filing taxes etc without any problem so far.

After 2 years of her landing, she filed for a renewal in June 2015 and application was accepted by CIC.
There was a query after couple of months of application to submit a color copy for her Passport as previously submitted one was not so clear.

She has called them many times but answer she is getting is - to wait until they decide as the application is still in progress and cant say much as there is no time limit to finalize the procedure.

Do you still think its on risk ?

The time she spent in Canada in 2008 is irrelevant. As I explained earlier, it's too old to be counted.

She needs to tell you the EXACT date she returned to Canada in 2013 and the EXACT date she applied for PR renewal in 2015. This is all that matters. Nothing else matters.

I got the exact dates this time.
She entered in Canada on 17th June 2013 and applied for renewal on 27th June 2015.
 
As long as she didn't leave Canada between these dates - she should be fine. It's probably taking longer because CIC is verifying that she does in fact have enough days to meet the residency requriement.

Thanks Scylla for your valuable opinion.
Please note that her PR was expired when she applied for renewal but she was in country and did not leave after 17th June 2013.

She should still be fine - right ? if yes then what is taking really longer than usual in this case, according to you.
