Does the application under common-law union has to be declared by commissioner of oaths? Or can it be Notarized?

It is only for co-signers. You are not using it for sponsoring a common-law partner
 
i know it says that - but send it anyways.

my application is in Buffalo and i thought i didn't need it since i have no co-signer, but they just sent me a request for it!

Perhaps they had issues with your particular relationship.

I have represented many common-law partners in successful sponsorship cases and it is not a requirement.

I do not recommend sending this document unless they specifically tell you to do so.

Make sure however to send at least 2 affidavits/statutory declaration from someone respectable who can attest to the relationship.

I really hope there is no issue with my relationship. I have dated my partner for almost 6 years and lived with him for 3 years and we provided ample support of our relationship! I hope that I just stumbled across one of the many poorly trained IOs that I know are out there as I work in a law office myself.

Anyways - doesn't hurt to include it (you could even just keep it with the additional proof of relationship section to show you know it is not required as there is no co-signor but it reiterates your CL status) so that you can avoid the delay should it be requested, however Amir is correct that it is not a requirement so its up to you!
