Hi there,

New to this website, hoping to get some really good information as told by friends :-)

My Case:
I am 23 year Indian Citizen in Canada on a student visa (EXPIRING AUGUST 31st 2013). I entered Canada on 4th Sep 2011 for a 2 year Diploma program. I took two semesters of it and then dropped out. I then enrolled in a (different discipline) one year post graduate diploma certification program (SEPTEMBER 2012 - APRIL 2013). I have been taking full time classes since my entry so no issues on voiding my status (except no classes in Summer, which is allowed).
I applied for a PART TIME WORK PERMIT, applied for my SIN and received it on 22/1/2013 (EXPIRY AUG 2013 same as my STUDENT VISA EXPIRY).

Now my program is ending in April 2013 and I plan to apply for my Off Campus Work Permit FULL TIME, which would give me a one year's working privilege in Canada probably until AUG 2014.


Question 1. I plan to visit India for my brother's wedding in the month of Aug 2013. Would it be an issue if I travel outside Canada on my full time work permit and try to re-enter Canada? Would they stop me to re-enter as my study is already complete? Also, would having a job before leaving make an impact on that decision?


Question 2: Would there be a better way to have a valid status in Canada other than going on FULL TIME STUDENT WORK PERMIT for a year?

Question 3: Can I use this one year work permit time (provided I work for 12 months on my work permit) towards my residency application/qualification if at all? Also, should my work experience align with my academic background to apply for PR? Can I work on jobs not related to my studies on this permit visa and can still be eligible for Experience Class?

Since your course ends in April 2013, you have ample time to apply for the PGWP. Not sure if you can get a TRV in the same application or not, but you would need that too. So you should have enough time to get things in order before you fly back to India.

so in answer to your questions:

1. As long as you hold a valid student/ work permit, you will have no problem getting entry into Canada. However, you will also need a valid TRV on your passport in order to board a flight to Canada. So if your old visa has expired, you will need to get a new one. Its better to get it done while you are in Canada however i think you may be able to get it back in India too (as long as you have a valid work permit).

2. Its a Post Graduate Work Permit. Your student status will be over when you get this new permit. Its an open work permit and allows you to work any job.

3. It depends on what category you apply under. I think Experience class requires you work in the field of your education but i could be wrong. Provincial PNP's have more lax rules. so check the category you are considering for requirements.
