I'm a December inland spousal + open work permit applicant and my app was returned to me. I haven't gotten it back yet so I don't know the exact reason. I applied for a visitor extension last month since my original visitor status ended February 28th. Haven't heard anything back from that yet.

So now I'm wondering if I have to do anything special in order to send my PR application back, since I am out of status according to my original date. I know I get implied status while I wait to hear back from the visitors extension. However, I am unsure if that implied status covers me being able to resend my PR app past the original date without any problems. I don't want them to look at my application, see that my visitor status lasts until the 28th of February, realize I resubmitted past the 28th and then tell me I need to apply to restore status.

And also, what if my visitor extension request is denied after I resend the PR app + open work permit? Am I still covered?

Thanks in advance

You are not out of status. You have valid Implied Status, which you will state in the app.

If the visitor extension is refused, you will be out of status and the OWP will also be refused. You could apply for Restoration of status if refused.

So the implied status for the PR+OWP won't matter at all if visitor extension is refused? That's worrying...but I also don't see any reason why it would be refused. Then again, whether I see it or not won't matter in the decision.

The PR application will continue to be processed even if you are out of status. As canuck_in_uk stated, if the visitor extension is refused, your OWP will also be refused.

An app submitted while on Implied Status does not give Implied Status.

Thank you for answering.

What are possible reasons for extension refusal? In the extension package I provided my sponsor's pay stubs, letter from her employer, wrote a letter stating my intentions and where the rest of my savings is dedicated to and that her paychecks are supporting me, and receipts from our PR + OWP application along with everything else that they required. I submitted this before 30 days of my original status expiring. I would think that all of this would guarantee me being granted the extension.

Am I right to assume that the OWP would be refused even if I applied for restoration of status soon after the extension was refused as well? Sorry for all the questions. Just want to make sure I have all bases covered
