Hello everyone,

I applyed for permenant residence last July, it's been more than 7 months since I have no news than of course the sponsorship approved in last November.

I also applyed for a temporary residence,a three months residency to visit my boyfriend at that time,(fall of 2010) my husbund at this moment, and I was denied back then. I applyed in a different country than my home country, I use to live in France in 2010.

My question is, do you think that my permenant residence process will be affected at this moment from this visa denied in 2010?

There is someone on this forum who happened to get through something similar?

I would appriciate any answer from you guys.

We are in a similar situation. Before we had our application finished for spouse visa (permanent residence), I (applicant for spouse visa) applied for tourist visa from England, where I was studying at the time (I am Indian citizen). I applied for Canadian tourist visa to visit my mother-in-law who lives in Canada and to see the country. My Canadian wife has been living with me in England at the time. My tourist visa was refused because my student visa for UK was going to expire in about 20 days. They also gave some more reasons like my family ties in both Canada and UK and travel history. We then applied for spouse visa at the end of the month in January and we are now living together in India. I have heard that rejection of tourist visa is not likely to affect your spouse visa application. They are many cases of people who have a spouse or other close family member in Canada who got rejection for tourist visa many times. Rejection of PR can cause rejection of tourist visa, but tourist visa rejection should not cause any problem. Dont worry it wont create any problem, but you MUST inform CIC about the rejection.

My ties for the country where I used to live (France) and where I applyed for a temporary visa they where unexistent, and also I was into a full process of divorce from my ex husbund, this was the reason I was denied at that time, no criminal records, not other reasons which would affect my permenant residance process.

I use to live only in France and Romania, no other countryes.

My visa office is in Bucharest Romania, and why I don't have a PR yet I really don't know, CIC is a mistery, we really don't know how CIC works at times.

I also am sure that a rejection it's not possible, but I guess it could delay the whole process.

In my application I already specifyed this visa denial, they ask you in the paper forms.

New Delhi is a very very fast office, once again lucky you!! :) ;) Bucharest is after New Delhi statistics tell us, but each case is different I guess.

don't worry it won't delay!!!!! :) or it shouldn't; ashunandal is right!!! so many r in the same situation, it's almost the normal way loooooool there r sooo many getting the same refusal reasons (us included, 3 times :-X)

but when u applied for that tourist visa did u say u want to visit ur boyfriend? was he the one inviting u? if yes than it's even one extra proof for ur relationship :)

what could delay a little is residing in different countries for a longer period of time...they need to do the background/security checks in all...also if u r divorced and now at the 2nd marriage and he is at his first, maybe they could question some stuff cuz it's a little different than the majority....but don't worry in case they have extra questions they will just confirm at an interview; they could also b satisfied from ur answers in the forms - how u described the history of relationship, etc.....

don't overthink, they r not predictable at all!!!!! stay patient and enjoy the time left with ur family!!!

maybe they just didn't open ur file yet....i think u r still in the timeframe no? if not contact the MP again :) she was helpful before so she will be again :)) good luck!!

When I applyed back then for a temporary visa of course I was very straight forward, sincer, I think to sincer, people like me get ( "pumni" in fata pentru restu care mint... :'() but no problem, very soon this process will have an end and I will forget about all this stress and anxity.

And if I am in the timeframe I really don't know becouse I don't know exactly when our file got in the sistem in Bucharest, MP said in January, do you think I should count 6 months from then?! It's insane! :o....we applied in July last year...shouldn't that count for something??!!

Ok, like you said, everthing will be just fine, but I am very anxious all the time for all this process to come to an end, staing far away from my husbund it's not easy at all but what we can do about it, absolutely nothing, just wait! I would realy prefer to have an interview than to wait for so long not knowing a thing...( e chiar nebunesc... >:()

We will contact my husbund MP once again if we don't have news...

you are most welcome! we are here to help each other and to share our experiences :) thanks for the good wishes. what is your ecas status now? maybe they are doing background checks. i know for sure the cases where there was a divorce take longer than others, but im sure you will get your visa soon!

E-cas status it didn't changed in a while now, from the end of November; 21 July recieved your application for permenant residence; 8 November we sent you a later concerining the decision made on your application.....from then a comletaly silence.

i'm fine!!! yes time passes and i hope our file will be opened sooooooon...may God hear ur words :)
i know everyone says be patient, be patient and it's hard....even me, i'm ok now (obviously! we just started) but who knows how i'll b down the road, and who knows if our road will b smooth or full of hurdles...all i can do is pray...i think i would go to church every day if I'd still b where u r; here they r but very few and far; so i just do it home, before i go to sleep...we accomplished lots of things in life (and I'm sure u did too!!!) and we will accomplish this too sooner or later :) the most important is to believe and to stay sane => don't let it ruin our health and daily well being

it's good that u were honest when u applied for TRV....even if it came with a refusal!!!!! and yeah it's sad that we suffer from the ones which are not...by the way, i saw u wrote on the December thread and u were surprised of mistletoes getting already her/his PPR....FYI there's another member also from December thread, from India, who got it in 27 days!!!!!! imagine that, some 27 days others 27 months!!!!!! it is definitely sad and frustrating but we can't do anything...and no i don't think it's really abt fairness; everything in Ca is based on statistics - percentage of marriage fraud (which surprisingly for India is high but also the officers r better trained to detect it, they have better experience ;) ) but not only; they also follow the applicants - new PRs once they r in Canada; their criminal records, how they adapted, tax fraud, how well the children do in school, etc etc etc...with all these they make statistics and that's why some offices r faster (less checks, more welcomed nationalities) and some r slower.....i did read an article abt this some time ago...
me tooo i would think an off-guard interview could b much faster than studying a bunch of papers...if the couple say they live together go check, ask neighbors, go to their address; call directly at an interview from the beginning without too much time to prepare....it would b much easier to talk to someone face to face....but for that they need to change a whole system i think, which takes time and costs money....

as for the timeframe, yeah i'm confused tooooo....unfortunately the time ur application stayed in Canada does not count in the VO's 6 months frame; but even if they have the application in the system in January, i think u should start counting from the day ur husband got the sponsor approval, November 8 (maybe 2 weeks after, it usually takes 2 weeks to transfer)...so yeah maybe other 2-3 months of wait :(....u can also order the CAIPS notes and see what they write there; ooh, one more thing, did u apply for the CSQ? (if u said before and i forgot i'm sooooooorry)...cuz some embassies wait for the CSQ too before they start processing....if u got it make sure the embassy has it, ask them to confirm....:)

if u feel they might have questions cuz of ur divorce, than be proactive!!!! gather more proofs since u applied, put together ur phone bills, emails, sms, chats, skype, gifts u sent to each other, if u traveled together, etc etc; maybe plan a trip together it will keep u busy ;) maybe he can come and visit u (for Easter!!!)....u will have everything handy just in case....

It's so good for people having you on this forum not just for me.. :)

You are so well informed and very helfull for many people in here.

I am just now started to learn more about all this process, immigration process,to tell you the truth I never intended to leave Europe ever but I got to know my Cnadian husbund in Gara de Lyond Paris TGV and since then my life turned into a different way. Is only his fault... ;), it is a to nice and kind and handsome men who have stolen my heart... :) ;). I knew in the first place will not be easy to get started a relatioship with my husbund but I never thought will be so hard and I never thought I will feel so much emptyness in my heart while I am so far away from him.(I was married once but never felt that, or not that strong I would say)

As for keeping ourselves honest and sincer, I agree, I remember right now when I was denied in the first place for the temporary visa, I have answered truthfully of every question to the immigration officer what she was asking, and when I was denied, while I was leaving the Embassy I was started to cry and I didn't care about anyone in the street, I was keep asking myself why I had to be so stupid and honest...but yes, you have right, we should be like this, it's easyer and fair to do if we lose at times we surelly have to gain in some place else..."what gos around comes around..." :) I was on the Chapms Elysees, it was such a beautiful day a sunny day and life was still beautifull...Now we are here and we are keep going this fight. Love can defeat everything in this world that is a fact.... :)

Of course I saw my husbund three times since our process is on but me and my husbund didn't think that we should keep proofs of our reconters, vacations. We will do so, and if they asking for more proofs we have plenty.An interview will be so welcome and will spare us of such anxity and stress, but like you said they have to change an whole sistem which is almost impossible.

All this process will come to an end for everybody sooner or later, for you as well and I am sure will be just fine, for some is sooner...(God! 27 days...India it's amazingly fast, I notice...) for some later on....

God always know what we need, and always hear our prayers where ever we are, He is around us... :) .

Even life is hard it's still beautifull.. :) ;).
