Hi Amir, Please be advised that i had filed my application with CIO on 13th May 2010 and received the confirmation letter from them in September. I had proved the language proficiency by submitting the communication emails from my office, the contracts, self declaration and all my degrees and transcripts.

So whats the procedure if CIO approves. Does visa office still ask for IELTS certificate.

Kindly advise.

As you sent a written explanation of your language ability after April/10 and before June/26/10 if the VO doesn't accept it as proof of you abilities, then you don't get a second chance to submit IELTs. The points will be give as to what the VO thinks. Be prepared to get a low mark.
 
But seniors i still don't understand that if IELTS was so important then why CIO approved the initial application without this score and Visa office is expected to deny inspite of approval being given by CIO. Isn't it that if IELTS was the main concern CIO should have mentioned in the letter itself but they did not. Isn't that sufficient for visa office. If the complete processing has to be done by Visa office then whats the use of sending documents to CIO.

Please advise.
 
One way to look at it is that CIO doe pre-screening and CHC does the full screening. Applications may occasionally slip through pre-screening but as far as each applicant is concerned what happens at the CHC stage is what determines your final visa outcome. At the end of the day its up to you , what advise you chose to take and how you proceed. i would think that as far as your local CHC is concerned you would be no different from anyone else reaching this stage and they would check that you have provided everything as was asked as per their checklist and would be more thorough.
The advantage of IELTS is that it provides a uniform standard against which you are assessed and to which they grant you points uniformly. You are not subject to the whims and fancies or moods of the VO.

Thus if you have been given a dispensation by CIO , good for you. Just be sure that the points from the language proof is not too critical for your 67 point pass mark. Without an IELTS submission , The points for this would certainly be totally dependent on the VO's own assessment of your skills. He may give you very good marks or he could also give you low marks. Do ensure that you explain to CHC that you have been given a dispensation by CIO

They need a third party evaluators of your english proficiency, they used to request for written explanation before but not with the new instructions.

WHAT IS THE PROCEDURE?

If you received second AOR from visa office, use that number as reference when you submit new IELTS score. When are you planning to take your IELTS?
Why do you need 16 points? Your total score is below 67? If you meet 67 or more, 14 points is sufficient.
