I have a brother-in-law in Canada studying PhD and has PR. How do I provide proof of relationship?
Plus, I'm not the main applicant, my spouse is.
 
birth certificate
passport
telephone/credit card bills (proof of residency)
 
that's it? no need for marriage certificate that he's married to my sister and a copy of my sister's birth certificate?

He can write a letter saying that he's my brother in law, etc and can I send it along with my application?

You have to show full proof that
a) He is your brother in law
b) That he is a Canadian citizen or Canadian permanent resident.

So for 1) you would need your sister's and your birth certificates to prove you have the same parents, and the marriage cert to prove he is married to your sister.

CIC want proof of everything and they will not take your word for anything.

Many people have failed despite having genuine relatives in Canada for the lack of appropriate evidence.

If you have more evidence than asked for then do not hesitate to include them.

But I noticed that application DOES NOT mention relatives such as brother-in-law, is that problem?

Your brother-in-law would be your WIFE's BROTHER....therefore, the docs related to this "Brother-Sister" relationship is important.

No, my brother-in-law would be my SISTER'S HUSBAND... my sister also had PR but not physically in Canada at the moment.

Ohhh!!!! I am sorry....yes that is another way to represent BIL. Good that we clarified on the topic .......if your sister is not physically present in Canada then NO points will be granted. You see the Points are granted for the RELATIVE in Canada.....it does not matter if your BIL is in Canada.

You or your accompanying spouse or common-law partner has a relative, i.e. parent, grandparent, child, grandchild, child of a parent, (sibling), child of a grandparent, (aunt/uncle), or grandchild of a parent, (niece or nephew), who lives in Canada and is a Canadian citizen or permanent resident.

Hi,

Sorry for the confusion and for misunderstanding you.

Mitali has it correct. Since this is your sister's husband he is not a blood relative of your OR your accompanying spouse. So if your sister does not live currently in Canada then you will not be able to claim these points.

Brother-in-law is accepted if it is your wife's brother. But if it is your sister's husband it is not.
