Hello, Hopefully someone can help me with my responses. I received a Procedural fairness Letter today under section 16(1):

- I only declared that I was denied in this year a visa to the US but I was also denied a US visa in 2013/2014. I want to explain to them that it was a honest mistake and I was not trying to withhold any information to misrepresent myself.

- My records have been expunged, so I checked no for committed, been arrested for or charged/convicted for a criminal act in any country. Why would I declare yes when I no longer have a record and since my expungement over 10yrs ago, I have never been arrested or charged with anything?

I have 15days to reply and will provide an updated police certificate from my country as well as the court document re: the expungement.

It is generally diffucult to convince IRCC that you were not trying to hide the previous refusal. Highlight the fact that you declared the most recent refusal.

It doesn't matter if your criminal record was expunged in your country. You still needed to declare it, as IRCC has to compare both the crime and pardon against Canadian law.
