Hi Guys,


This may be a tongue twister but I need some serious advice.


I live in Canada for past 1.5 years on work permit. My wife stays out of Canada we applied for her work permit last year & got approval in June 2014. She arrived in Canada in January 2015 , but has decided she does not want to leave her job back home at the same time wants to obtain PR as a backup plan.

We together as a couple moving on in life is out of question as she decided so.

I applied for PR as principal applicant in December 2014. Have recently come to know thru these forums & specialized lawyer , 2014 quota is full hence expect your file being returned any moment.


Now I personally don't see my family life & career moving forward with her & in Canada.I have no issues, if there is an option for her going forward for PR without me.


My question is , can she proceed with PR application from outside Canada as a principal applicant even though I decide to leave the job , Canada & PR application for good.


Please advice!

My case is simple at least on work front.


My paper work right from day one including pay stubs is fulfilled. My IELTS was cleared.

I arrived in Oct 2013 on work permit thru LMO & applied for PR in December 2014.I am working in the same company right from start till date.

My wife stayed back & we did an open work permit for her & received approval for same in June 2014.

Since she has settled down at her work & does not want to leave home country but as a backup plan she wants to have her PR done.

We both together moving forward is not happening. As she has decided to leave me.

I am very much upset with the situation have decided to leave Canada for good.

Now thru forums & lawyer have come to know all applications are being returned because CIC 8000 application quota was full by October 2014.

I have no issues her proceeding with PR without me , so my question is, earlier I applied for PR as a principal applicant, now can she re-apply as a principal applicant if the file gets returned.

Or for some reason if our application continues without being retuned by CIC, can I go back to my home country & can she have her PR?

She can apply as principal applicant if she qualifies. But it's not clear why she would do that if she doesn't want to live in Canada.
