Hi folks,

Good day to all. May i ask if who had same case as me. Im 3 month pregnant now and I have a PR status since oct 2016. I plan to deliver my baby here in canada by dec 2018, and my husband who is not yet a PR is a politician in philippines ( thinking he will never apply for PR). He plan to take the baby back to philippines by baby’s 6th month.

Will there be an issue if the Canadian Baby will stay to the philippines as long as he/she like without revoking his own canadian status? I (the mom) probably cannot keep my PR status as well so we can be altogether in philippines. Or do i have to maintain my PR status or do a citizenship just to keep his status?

What if my baby (who become an adult in future) decides to go to canada again? Will there be no issues in coming back? Please help me. Thank you in advance
 
Yes, if your child is born in Canada the child will remain a citizen. For many provinces there is an up to 3 month waiting period until you will be covered by Canadian healthcare. There is also an over 6 month residency requirement needed to receive health coverage and not be possibly asked to pay any costs incurred. Your husband may struggle to receive a visa to come to Canada given your PR status.
 
Should mention that given your over 6 month stay you will have to pay taxes and declare your household (husband's) income. Only fair if you intend to use the healthcare system then return to your home country for good.

1. It is unlikely that she would have to file income taxes in Canada with no earned income.
 
Under current law, your child wouldn’t have any issue returning to Canada in the future. Of course, no one can say what may happen in the next 18 years before your child is old enough to return in his own. Attitudes may change and laws with then making the fact they were born in Canada irrelevant.

She should file if she has remained here over 6 months (think that is the amount of time required). No idea what her household income is but at least she should not get a return.
