Dear friends here I want to discuss a case of my friend with you:
She is a staff nurse and we applied her case under noc: 3152 in 38 categories. She has done three year diploma in GMN after senior secondary for which she is getting 22 points. She is having 07 years of experience so for that she is getting 21 points. Her spouse has done one year diploma for government ITI after senior secondary for which she is getting 03 points and she is also having a blood relation for which she is getting 05 points. She has done IELTS with overall 5.0 bands (L: 5.5, R: 3.5, W: 4.5, S: 5.5) so for IELTS she is getting 06 points.
So few days earlier she received her refusal letter dated: 30/01/2012 from CHC that they are refusing her case because she is not getting the sufficient points.
Interesting in the refusal letter is that they said “Your application was assessed based on the occupation in which you requested assessment as Licensed Practical Nurse (NOC 3233)”. In her entire application she had never mentioned that she is applying under 3233 NOC. She always stated that she is applying under 3152 noc (Registered Nurse) and in all the experience certificates she submitted at CHC it was stated that she is working as a Staff Nurse.
Second point is regarding the points of her spouse's education. Her spouse has done Senior Secondary and after that he has completed his one year full time diploma in Motor Mechanic trade from Government Industrial Training Institute and completing 13 years of regular full time education. She submitted all her spouse's certificates and Detailed Marks Cards. So for that she should be given 03 points but instead of that the visa officer did not provided her any point stating that for any other education to be considered we would need to have seen the evidence of marks/grades and a curriculum. So the visa officer did not provided her any point for her education.
More interestingly after that refusal letter she received one more refusal letter dated: 05/03/2012 from CHC that they are refusing her case because she is not getting the sufficient points.
In this letter one mistake was same that “Your application was assessed based on the occupation in which you requested assessment as Licensed Practical Nurse (NOC 3233)”. In her entire application she had never mentioned that she is applying under 3233 NOC. She always stated that she is applying under 3152 noc (Registered Nurse) and in all the experience certificates she submitted at CHC it was stated that she is working as a Staff Nurse.
So in this letter he provides her the 03 points for her spouse education but at the same time under the points table there is a wording same as to the first refusal letter stating that he is not allotting her points for her spouse's education with the reason stating that for any other education to be considered we would need to have seen the evidence of marks/grades and a curriculum
And in both the letter he also did not provide correct marks for her IELTS. He provide her 05 points but according to GUIDE 7000 on CIC official website she is getting 06 points.
So please suggest what to do in her case.
Kindly reply........................
Thanks.......
