We had tried to have him come to Canada on TRV to meet my Mother prior to our marriage but was rejected once, and the second application is still in process 4 months later... but we have very very strong paperwork this second time. But now that the actual marriage has happened I am worried they will refuse based on me being a tie here. However we are now applying for his PR status as my spouse in the mean time and including ammendment to the TRV application to state that the intention is still to meet my Mother and that he will not overstay and that there is a PR application in process as well.

He is an Indian national. Our marriage was registered via Hindu Marriage act in India. He lives in Jammu / Kashmir and there are no registrar of marriages in J&K state. They go through sub-registrar and initially they only signed the marriage documents with a 'notary' stamp and also trasury board stamp. It's perfectly legal, however his friend who works with immigration in India said Canada will definitely require registrar stamp and not accept notary stamp for PR application. Problem is sub-registrar in J&K would not stamp it without a close blood relative of mine to witness. My Mom is my only close blood relative and she can not travel due to health. Obviously him coming here to do a civil ceremonyis out of the question as Canada will not allow someone to come on a TRV to marry.

So what do we do?? Will CIC accept a notary stamped marriage certificate as proof of marriage? We did try to see a Magistrate just before I left, which resulted in me signing 14 blank pages (which supposedly will be typed later) and have sub-registrar stamp it. This cost is 2500.00 CDN to do at the last minute (since the magistrate took advantage of us knowing I had to be on a plane 3 hours later!!) I had to be there in person to sign it.

So what Indian document is acceptable as proof of marriage for PR application as spouse???

We have:

- Marriage Certificate from the Gurdwara (Sikh) from the anand karaj ceremony
- Notary stamped marriage contract (also stamped by treasury, advocate etc)
- Hopefully also now sub-registrar stamped copy.

How long will it take for him to be approved?? I am in the Canadian military and only have enough leave each year to make one trip to India viable since it takes 2 dfays travel each way... I need to take at least 3 weeks in one go to make it worth the 2000.00 airfare which means using nearly all my leave at once (saving a little bit for emergencies etc).

I know Canada puts the burden on the Canadian spouse to do the travelling in the mean time while PR is being processed. But since I am serving my country this is not possible. So we can only see each other once a year for a few weeks until he is approved?? Pls advise, is there any way to expedite the application, especially for military personnel serving their country and unable to just pack up and travel whenever we want to?? I have heard of the military attache in Delhi (who is in same building as CIC and the High Commission) expediting the application for military member who married an Indian National due to the reasons I stated above... the constraints of serving our country will directly keep our family apart unless the spouse can come to Canada.

Is there any tempoaray visa that a spouse can obtain?? I know TRV will be rejected for most spouses as obviously they will suspect that the person will overstay since the spouse is a 'tie in Canada'. It seems this system is set up to purposely keep valid families apart. There used to be a fiance visa whereby they could come to Canada and marry legally here. But this no longer exists... and TRV will never be granted for the purpose to marry a Canadian citizen... so I am confused as to what to do.

Do we really need to go two years or so without seeing each other aside from a few weeks when I can get leave from the military and go there?? That really strains a marriage!!!

And what exactly does CIC need as far as marriage proof from India???

You can certainly try contacting the military attaché to see if he will help. Can't hurt. If it does work, please let us know.
