Hello everybody! and happy new year 2013!

I need help and recommendations about my case; I'm a Canadian permanent resident since February 2012. My girlfriend is a US citizen and she has a 3 yrs old child from a previous relationship, she already has the custody of her child. We were planning to get marry this mars 2013 in order to be able to sponsor her and her child but plans have changed, we have just realized that she is pregnant and also I noticed there's a new regulation:

Effective October 25, 2012, sponsored spouses or partners must now live together in a legitimate relationship with their sponsor for two years from the day they receive permanent residence status in Canada.

We've decided that the new baby is going to be born in US for insurance reasons, I don’t know if it’s going to be harder to sponsor my family now, should I wait until the new baby is born to apply so I can be exempted from the new regulation of the two years relationship? I don’t have job yet in Canada, hopefully at the moment I would apply I would have one already. If not I also can prove that I can be economically responsible for my family. How long would it normally take this process?

Does anyone have experienced something like this? I would love to settle my family in Quebec instead of staying in USA, in the worst case I will have to moved to USA and forget about Canada if things seem to be too complicate it.

The conditional PR applies after sponsorship and landing. It isn't a requirement beforehand. You still have to meet relationship criteria (common-law for one year or married in your case).

The two year rule only means if you two separate or divorce within two years of her getting her PR, she may be stripped of her PR and returned to the USA.

Lets be positive. You're going to be together forever so no worries! Congrats on the new baby!

PS: As a US citizen, your gf can co-habitats with you in Canada as a "visitor" (but no working or studying). If you can afford the single income, great option so you can be together. :)
 
Btw, you don't have to have a job - but no social assistance. Proof you're job hunting and ways to support your family are okay. (Such as help from other family and savings.)

Outland USA is about one year published. That means 80% of cases are processed in 12 months or less. If she has the baby during the process, you have to submit new forms to add the baby.

First, you must make sure you qualify as common-law (12 months continuous co-habitation) or get married. Make sure to refer to her as wife in your application as she would be your cl wife! :)

Now I feel more positive about going all to Canada, so once I get married I will start the application process and then add the newborn.
One more last question, would you recommend hiring a lawyer to do all this process or is easy if I do it myself in Canada?

I'd only hire a lawyer if there any serious issues with your application such as criminal convictions, huge age difference, or something that would make your marriage taboo.

You're a USA and Canada couple. There's probably no need. Any questions, you can get great help here. I actually consulted a immigration firm and they knew less than forum members.

My only question is... You weren't sponsored by a spouse, right?

Also, let us know your province. Sometimes we can get even better info that way ;)
 
Yes I totally agree with you Hello amikety , the information I've read here is so valuable and in most cases more precise than any other source. I obtained my CSQ and PR applying as a skill worker, I’m currently living in Quebec and my GF in USA. That sounds just perfect, I'd apply by myself, we are both almost same age 29, we have no criminals records, and we have been together for about two years, so I think we don’t have nothing that might be considered as suspicious. I think that I will mention at the moment of filling the application that we are expecting a baby.
