Hi there,

My wife and I recently relocated to Winnipeg, MB from Australia. We have encounted some potential issues with our relocation and I am hoping someone here may have had a similar experience or can assist us. I have included a brief time-line of events below:

1. I applied for 'proof of Canadian Citizenship' in March, 2013. My mother was born in Canada. I was told the processing time would be at least 14 months.
2. I received a job transfer offer from the same company I was working for in Australia to transfer to Canada in May 2013. I applied for a working visa through "intra-company transfer" and my wife applied for an open work permit which is tied to my visa. Our visas were both approved and we departed for Winnipeg
3. We arrived in Canada on July 24th, 2013 and I commenced work on July 25th. Our work permits are valid until July 30, 2014
4. My wife found a short term contract job in mid August (3 month contract) and is continuing to seek full time work
5. I received my Canadian Citizenship Certificate in mid September, 2013.
6. My wife and I realised I would now not be able to renew my work permit, and so we decided to apply for her Permanent Residence through an Inland application with me acting as per sponsor. We are legally married.
7. We mailed her PR application on Septeber 24th to CIC, Vegreville, AB. I have not yet received any notification that they have acknowledged our application.

My wife would very much like to continue working in Canada during the processing period for her PR application. I have been advised that it may be possible to apply for an extension of her current open work permit if we make reference to the fact that she has applied for PR. Is this true?

Any help or advice you could provide for our unusual immigration situation would be very much appreciated.

Normally, if you had applied for an open work permit along with the sponsorship application, she might have been covered by implied status.
However, in your case it's a lot more complicated as your visa/work permit may actually be void now as you have had your Canadian citizenship confirmation. As hers is directly dependent on yours, it might also be void. In your situation, I'd be talking to CIC to find out exactly what the situation is.

I agree with Zardoz. I think your wife's work permit was likely voided when you were confirmed as a Canadian citizen. I would seek legal advice.
