Dear All,

Can you advise on the below scenario?

We landed in Canada in Sep 19th 2014 and stayed in Canada for 2 weeks and came back to my home country. Now we are planning to go back to Canada and thus we will entering Canada approx. after 4 years since last landing.

I want to ask the following questions:

1) Can we be questioned by an immigration officer that since we cannot fulfil the criteria of 2 years of physical presence (from 5 years)?

2) If not, and lets say we are still able to enter Canada and then after staying in Canada for continuous 2 years, can i apply for the renewal of my PR? by this time my PR would have been expired by 1 year ago...

I will appreciate guidance on the above scenario and looking forward to hear.

Please forgive me for asking, but why did you apply for the Canadian PR in the first place?

1) Yes. It's possible the CBSA officer may officially report you for failing to meet the residency obligation. If this happens, you will be allowed into Canada but will have to appear at a hearing to argue why you should be allowed to retain your PR status. Unless you have strong H&C reasons for failing to meet RO, you should expect to lose your PR status and be ordered to leave Canada. Education and employment are not accepted as valid reasons for failing to meet RO.
2) Yes - you can do that if you are not reported at the border. You'll need to avoid all trips outside of Canada (even emergency trips) for two straight years.
