Hi Gurus , Please help me . My question is

1) I landed in Canada on 7th March 2011 , but I went out of Canada after 45 days and came back to India . I ultimately came back to Canada on June 30th 2014 . From now onwards I intend to stay continously for 730 days to meet the PR obligations for renewal . But as my landing date was 7th March 2011 , my PR will expire in 7th March 2016 , by that time I will not complete my mandatory 730 , what will happen will they deport me or can I stay back wait for 730 days and apply for renewal of PR .

No, your CARD will expire, not your PR status.

You must stay in Canada and not leave for any reason, until you reach the 730 day obligation. At that time you can apply to renew PR card.

As long as you stay in Canada, you will not lose PR status or be deported.

Hi Guru , thanks for your comments , Now interestingly the expiry date in my PR card is 22nd NOV 2016 even though if I count from my landing date of 7th March 2011 my PR expiry will happen in 7th March 2016. I hope If I stay beyond this time and finish my mandatory 730 days , I can still renew my PR I hope ?What do they check for renewal of PR card . The expiry date in the PR card or the Landing date to check for 730 days or the date of application for renewal

If you are in Canada and you stay out of the way of immigration (that is don't leave, don't apply to renew PR card and don't apply to sponsor anyone) until you meet the RO (residency obligation = have at least 730 days in Canada in the past 5 years), you will be able to renew your PR card.

There is no such thing as a "PR expiry". There is a PR card expiry which has very little to do with your PR status. For your PR status, it is most important that you meet the RO. If you have stayed outside Canada for such a long time that you will be unable to meet the RO on your 5 year PR anniversary, you are already in breach of the RO and will be until such a time that you have 730 days in Canada in the past 5 years. At that time, you will meet the RO again and can renew your PR card without any problems.

Hi Leon, so it is not that if I don't meet RO in first five years/by the expiration of your PR Card, I will be barred entry. It is that at any time before your PR card expires, I enter Canada and meet RO, then I am good to apply for PR Card renewal. Did I get it right?. Thanks.

Only if you are able to enter Canada without being reported. If you don't meet RO and you are entering Canada, there is always a chance you may be reproted at immigration for failing to meet RO. If you are reported, you will be called to a hearing within 30 days where you will have to argue why you should be allowed to keep your PR status without meeting RO. Reasons like working or studying outside of Canada are not accepted as valid reasons for failing to meet RO. If you fail to keep your PR status at your hearing, your PR status will be revoked and you will be ordered to leave Canada.

If, on the other hand, you are able to enter Canada unreported - then yes, you can remain in Canada until you meet RO and then apply to renew your PR card.

Thanks. That cleared an important point. Now, the cut off point to most likely be reported would be around three years out of first five years, correct?. Because if I enter Canada by the end of three years, I can still fulfill my RO by staying in Canada for last two years of my first give years tenure. am I right?. Thanks.

You should NOT be out of Canada for any more than 1095 days. Does that make it any easier for you? If you are out 1096 days, then you are in danger of being reported for breach of RO as you can not meet 730 days before your 5 years are up. Granted, the danger is minimal, but still there. 1095 days outside of Canada in any rolling 5 year time period after landing as a Canadian PR is the maximum to ensure you meet your RO.
