I got immigration to Canada in July/Aug of 2009 and took my family to Canada in the month of September 2009 so I was confirmed permanent residence.


I had to come back to India within two weeks and when I came back to India - I came to know that due to photo mismatch they wanted me to be present in person in Canada for photo for PR card, which I couldn't do since I was in India.


Now I want to get my PR card and planning to visit Canada for getting the same. But I work for a Canadian Company and has been working for them for last more then 5 years. My company is willing to give me a letter to this fact and if this is not a strong reason then can I get my PR card on Humanitarian and compassionate (H&C) grounds since I was looking after my aged father who died few months. Once I get my PR card then I can travel back to India- is my understanding correct???

If has any sample of filled form for applying on Humanitarian and compassionate then please share with me.

My question would do I have a realistic chance of getting my PR card.

I am planning to visit Canada around 15th of October.

Unfortunately there's no guarantee you will be able to keep your PR status and renew your PR card.

Working outside of Canada for a Canadian company does normally allow you to count these days towards your PR residency obligation. However in order to do so, you typically need to be hired for a job in Canada first, work in that role for some time, and then at a later date be transferred outside of Canada. It sounds like you were hired directly for a role outside of Canada. CIC may therefore not allow you to count these days as days spent in Canada. However you can certainly give it a try and see if CIC accepts the paperwork your company provides.

You can also try renewing your PR card based on H&C grounds. You will need to prove that your father's illness prevented you from returning to Canada (e.g. through doctor letters, hospitalization records, etc.) and that there was no one in your home country able to take care of him in your place. Again, it's important that you provide strong evidence if you are going to try the H&C route and this evidence must cover the entire five year period you were outside of Canada.
