Hi,

I came to Pakistan on 20Jan2020 and oversight the PR Card expiry date 05Dec2019. I meet residency obligation (1001 days from 20Jan2017 till 20Jan2020).

I am pregnant 27 weeks. I have applied for PRTD but may not be able to travel after 4 or 5 weeks (by the time i may receive PRTD). In that worst case, I will end up delivering the baby in Pakistan. My husband is the main Immigration applicant residing in Canada with my daughter there. They also meet residency obligation better than me.

Question 1: Can you please guide or refer to the link/discussion explaining what will be the process of returning back to Canada with the new born Pakistani passport holder baby?
Question 2: What about the nationality requirement of the new born baby from the perspective of number of days of baby's stay in Canada VS ours? (I mean will the baby will also be required to stay in CA for 3 years?)

Your spouse in Canada will have to sponsor the baby from Canada. You can try get a TRV for the baby to come to Canada. If denied you can try applying for a TRP. Yes the baby will need to meet their RO as a PR. Once aPR they can be included in a parent’s citizenship application.

Our 3 years stay for nationality should be finished in 2020, So if we apply for nationality; we wouldn't be able to apply for the nationality of the baby?

As long as the baby is a PR when you apply, s/he can be included in your citizenship application without meeting the 3 year physical presence requirement.

Father is currently PR but will be eligible for citizenship in 2020.

If I don't get PRTD in next 4 weeks then baby will have to be born in Pakistan. Father will have to sponsor the baby. At the time of sponsorship, father will be PR and I will have PRTD hopefully.

So our plan should be:
1- Father should go to Canada and sponsor the dependent child. When i checked the processing time for sponsoring the dependent child....Canada.Ca didn't give any timeline. I am scared now!

Question 3: Any idea how much time generally it takes to sponsor a dependent child (new born baby in Pakistan)?

2- At the same time, we should apply for TRV. Explanation letter should mention following.
a) Mother PR Card is expired on 5Dec2019 therefore couldn't return. Physically spent 1001 days in Canada since Jan2017. PRTD received.
b) Infant cannot stay alone back in Pakistan. Daughter studies in Canada and her education is being impacted.
c) Return ticket attached to follow the law or the process.
If TRV is approved, happy landing in Canada. Keep extending TRV (if expiry is close) until sponsorship is answered positively.

3- But If TRV is rejected, follow TRP.

Question 4: Can anyone please second the above plan (1,2a/b/c,3)?

Once all of us, resume in Canada; in next 2 or 3 months we would have spent 1095 days (eligible for citizenship) except the baby. So i think what I am getting from @canuck_in_uk is that we may apply for citizenship for all including the baby. But baby must be PR by then & not on TRV/TRP.

Sponsorship is usually 5-11months. Do not buy any ticket until you know TRV is approved. If TRV not approved try TRP. You will need for baby to get PR before including in sponsorship. Baby should have private medical insurance until they qualify for health insurance. This depends on the province. The rest of your family may need to reapply for medical insurance depending on how long you spend in Pakistan. There are separate residency requirements for healthcare in each province. A valid health card actually doesn’t guarantee valid health coverage.
