I am an employer of a live-in caregiver and we are trying to extend her work permit (which expires May 2016) to continue working for us. I have gotten conflicting opinions on whether the LMIA exemption applies to people who meet all the criteria, including having already applied for permanent residency. In her case, she qualifies for everything, but has not yet applied for PR. I have already submitted the application for the LMIA exemption, but am now being told by an independent agency that she might have had to apply for PR status before I submitted the LMIA exemption application.
Does anyone know if this is true? I submitted the LMIA exemption application and paid the $230 fee a month ago.
