Hi,

My husband, older son and I are Canada PRs. We are Indian, but live a life of corporate gypsies - travelling wherever work takes us.

My younger son was born in Sept 2013 in Bangkok, Thailand.

I intend to relocate to Canada in May 2014 to complete my PR obligations, as well as to finally settle down.

When trying to figure out how to apply for PR for my younger son, i came across these 2 steps:
1) I (or my husband) need to sponsor him with sponsorship application possible only from within Canada
2) I need to apply for PR for him in his country of origin or where he has lived for over 12 months.

I have a few of questions - would be great if someone can answer them for me:
1) If i have to go to Canada to sponsor him, how long do i have to stay there? I.e. can i fly in for a day trip and send off all the documents? or do i have to stay on Canadian soil till the sponsorship is approved
2) He is less than 2 months old - how can I apply for PR in a country where he has lived for at least a year? We dont have a permanent base in India anymore, so if i were to apply in India (as his country of current citizenship), there is no postal address that is monitored in case of any communication from the CIC. Can i apply in the country where i currently have residence, even if he has not lived here for a year?
3) What would happen if i apply for his PR where I am current residing, and then take him with me to Canada in May 2014 on a TVP (and extend every 6 months till we hear the outcome of his PR application)?


Pls help - am getting quite stressed out given the impending move in May 2014.
 
There are questions you will need to answer I think before anyone can give you accurate information.

1. When did you and your family land/become PR?

2. How long have you spent in Canada since landing/becoming PR?

I do know that one of you, either your husband or yourself will need to settle in Canada BEFORE you can even attempt to file sponsorship paperwork for the baby and will have to remain in Canada for the duration of the sponsorship process. That being said, the answers to the questions posed will determine how/when you should even try to start that sponsorship.

I think the application will be processed in the country of his citizenship, India. But in theory, since the baby is only 2 months old, you might be able to process it in Thailand as well as long as you prove that the baby has been lawfully admitted in the country. I'm not familiar with the laws there, but I believe since the baby was born there, this shouldn't be an issue.

You will have to go to Canada to sponsor him and you will have to remain there for the whole duration of you application (you can leave for maximum 2 week vacation maybe). Either you or your husband would have to be the sponsor. One of the requirements to qualify as a sponsor for a PR holder is that the person MUST be residing in Canada. The CIC definition for residence is = permanent home (and you must prove that you have this type of connection with Canada)

All communication will come to you, the sponsor, because the child is underage and you are the legal guardian. The communication is usually done by email, except for the COPR and PPR.

You cannot apply for PR while outside Canada. If they find out, they will disqualify you as a sponsor and will deny the PR for your baby. They are very serious about PR holders and sponsorship. Only Canadian citizens can sponsor while outside of Canada. I also assume, from what I've read, that you will have a hard time getting a TRV for your baby. With 2 PR holder parents, the chances of the baby leaving Canada when the TRV expires are close to zero, and this will not play in your favor. TRVs are usually denied for people that have strong connections to Canada, and your baby has both his parents, no ties to India, etc.

This is just my opinion, maybe other members can give you some ideas that would work better for you.

Either you or your husband must stay in Canada during the ENTIRE processing time. You are only allowed to leave for short trips/vacation.

I believe his application would be processed in the country where he is planning to live for a year. Your son would need to have a visa to that country for at least the next year. In this case it would be Singapore visa office (processes Thailand apps)

Else, I believe his application would be sent to visa office based on his citizenship (India). You can put the mailing address as anywhere in the world, so correspondence does not need to go to an Indian address.

As mentioned above, you or your husband MUST be residing in Canada to even submit the paperwork.

Also note that your child will need a TRV to come to Canada. There is no guarantee this will be granted, so one of you may need to prepare to live with him overseas until his PR is fully approved. In this case you will need to make sure the parent that stays overseas, will still be able to meet Canada residency obligations for PR if the child application takes a long time, else they risk having PR revoked.

2) I need to apply for PR for him in his country of origin or where he has lived for over 12 months. pr should be applied from canada what would be your plans if hus moved to canada . do you have visa to continue in thailand r move to india . It depends on you can ask for your country of residence to process childs papers

In this case you can mention your email address in which all communication will be sent to it but problem is when newdelhi asks for passport you may have to move to india and settle for some months until it is processed
