Hello

My postgraduate work is about to expire. I am in the Express entry Pool under experience class. My Employer is refusing to do a LIMA so i can get a work permit and work while I increase my points (by taking my CELPIP again). Told the bridging visa is only for those actually invited to apply for PR.

Please advise?

Yes, only those who have already received ITA and submitted their complete applications qualify for a BOWP. So unfortunately this means you don't qualify at this time. How many points do you have right now? How soon is your PGWP expiring?

If your employer isn't willing to obtain an LMIA, then you most likely don't have a means of continuing to work after your PGWP expires. In that case you should apply to change your status to visitor before your PGWP expires if you want to remain in Canada.

I have 362 points will be 371 when I update to 3 years work experience. Plus about another 30 points for taking CELPIP next testing in my area is not until 19th September again, bringing me to 401 points). Trying to see if can get points for my foreign education certificates. If I am just a visitor how am I supposed to pay for rent etc? Why am I being penalized because my Employer has no intention of helping me or any other foreign worker other than giving an Employment letter?

Realistically you need in the range of 470+ points to be sure of selection through Express Entry now. I would recommend you start looking into the PNP programs now if you haven't done so already.

Employers are under no obligation to go through the LMIA process and many people qualify for EE without having job offer points.

If remaining in Canada after your PGWP expires without working isn't feasible for you then the best option is to return to your home country with the plan to return to Canada once you are approved for PR.
