Hi,

My partner & I are in the process of thinking about applying for a working holiday with our kids in Canada (Alberta). Once we have gained 1 year work experienced we want to apply for PR. We will be applying through PR with my partner as the primary applicant. However, in my criminal/police check I have an instance where my gun safe wasn't installed correctly to the wall (the gun and bullets where locked inside though). I received a fine and NO prison/jail time. Just a $600 fine. Would I still be able to apply and be granted the working holiday and possibly PR with this on my criminal/police clearance? I have NO other instances EVER! Would this cause any issues in not gaining PR etc?

I don’t believe that should be an issue. A fine is more of a civil offence and should not be on your criminal record. Does this fine show up on your police clearance?

It might cause a little bit of a headache... careless storage of a firearm is not merely a regulatory offense, but it is part of the Canadian Criminal Code (offenses from other countries are evaluated against Canadian law). However, "not installed correctly" may not be a problem, and may depend on the type of firearm, and now I'm way over my head : )

So it might be worth it to get a legal consultation - Otherwise, you can just explain what happened, and wait and see... Ultimately I don't think it will be a problem, but a headache? Probably...
