PMM ,

Appeal application sent july 15th, 2009 within Canada. Arrived to vancouver on July 3rd 2009 as visitor. visitor permit expires Dec 2nd 2009. I am Mexican citizen Mexicans citizens need visa to enter canada as of July 14th 2009.

I called on Oct 20th to check status on appeal , file to be in Canada no later than Nov 25th per Refugee board offices ( appeals ). then ADR or full hearing

1.- What are my chances of getting the visitor extension approve while i have an appeal in process ? all I have is a confirmation from the appeal division regarding my wife appealing the results.

2.- If visitor extension is refused, would that affect my appeal process? meaning if they need me to testify can that be done by phone? usually when appealing an outland application the person being sponsor is overseas , in my case im still in Canada as before we did not required visa to enter canada ( mexican citizens)

I would think that the extension will be refused. Telephone testimony is done all the time. The ADR or full appeal can be anywhere from 8-12 months or more in the future.

PMM could elaborate on it , would immigration refuse the extension on the visitor visa and send me back to my home country ( Mexico ) and wait for the appeal process outside ?

I have the requirements on the extension , wife a canadian , money on the bank , acknowledgment letter from appeals division regarding the appeal in process etc.

Im in canada living with my wife for over a year now, never got any of my visa to expire leave the country and return , but now mexicans need vida , which im sure they will refuse a new application for visitor since the appeal is in process.

i'm wondering why would they separate families to wait outside of Canada when Im already living with my wife in Canada. ( i wonder why would they separate us , when in the first place we didn't past the interview because the marriage was too short , now by leaving she will have to visit me outside to keep our marriage alive ?

Im not questioning you , Im asking , please could you elaborate on it .

Because I assume that you application was refused because that CIC doesn't think that the marriage is bona fide. If they don't think the marriage is bona fide, the claim of living with a wife in Canada won't hold too much water.
