pls Help - would I be qualified for 0213

Hi Friends,

I am working as an associate Tech Lead in a software company. I've got 1+ years experience in this role and 7 years experience altogether as a software Engineer. For the last one year, If I manage to get a letter from HR with the following duties, would i be able to get qualified under 0213.
please advice.


1. Supervising and leading software Engineers to design, develop sofware solutions in the product
2. Interacting with clients and participating in requirement analysis in order to arrive at solutions, time lines and cost estimates
3. Participating in the recruitment process by reviewing CVs, intervieving potential recruits to hire software Engineers
4. Providing technical Training to junior software Engineers.
5. Partcipatipating in software Design and code reviews and making reccomendations
6. Mentoring of software Engineers
7. Design, development and Testing of software modules in the product

I am not sure but since these responsibilities do not talk about budget control and your responsibility to hire and fire, It may get tricky as we have seen in case of summer long. But there is no harm in trying.

Is there some way for you to convinve HR to mention about budget control and hiring decisions.

Also do you meet the qualification requirements mentioned in the Job description of NOC 0213

If he gets File No from CIO, does it mean he will sail through comfortably for Minimum requirement criteria from Visa Officer at New Delhi ?? Because if application is rejected in this phase, Ruka wont be losing any money (processing fee).

SD, it will be hard to say at what stage they may or may not raise a concern. I am no expert and am in initail stages of my application but my thoughts are that ruka may not have a problem at all. One good thing is ruka meets the educational qualification required for 0213 which is a positive sign.

If there will be a problem it may happen at CHC stage as they will ask for detailed reference letter as in case of summerlong and detailed final determination of eligibility happens at this satge

Financial planning and budgeting of a project is an essential duty. Tech leads are usually not exposed to that.

why do you say financial planning and budgeting is necessary? In the web site they only say 'All or some of the duties'.
please clarify why do you say so ? Have you come across any rejections who have applied without this duty?

You have to distinguish yourself as a management personnel. Budgetary duties is one way to separate yourself from the pack.

A person could do some of those duties (say like 7) without being a manager. The trick is to show that you had management duties.

BTW I am not saying that you won't qualify for 0213 and I am not saying don't apply. In fact, I don't know what they expect from 0213. I am just writing to say that you should emphasize management capacity, else you would just be a 2143 (or whatever number that is). Remember, the cost of applying is little so you may as well try.

sorry i meant it differently. if you don't qualify for the immigration based on NOC code before processing, then you get all your money back i think.

ruka, as rupeshhari said that you get your money back if you do not qualify, so you block your money for few months.

In my opinion if possible please check with HR if they can add something about budget control.

Management role usually have financial responsibilities (Cost Center) and employees appraisal (development and input into hiring/firing). You don't need management title but your job responsibilities should align to management functions. If you are not directly managing resources/cost center, you can reflect them under various projects which include planning, resource and financial management. Good luck!
