Dear All
I need expert advice and expereince of the people who had similar situation. I have valid PR card, SIN etc with me for my family as we landed Canada in 2008 April. I am now returning back in April , though i had only 1 month stay and moved out of Canada Via US- Road border. Since my stay is only for 1 month and i dont meet obligation of 730 days, i am bit afraid what will happen to me and my family at Airport or at Road bordr when i am entering into Canada
Pls advice which is the saftest route
1/Vai Road thru US , as we have B1 visa of US for my family. What canadian immigration officer will check and what can he do once he sees PR card is expirying in June 13 and how he will know whether we didnt stay 730 days? Will he have powers to reject or entry to Canada and how do i handle such situation. I dont want to return back and want to settle in Canada
2/ If answer is yes than how do i cross the border, a) By Taxi bearing US number plate or Canadian Taxi to get me crossed from US to Canada. Suggest some other alternates also and what is the right time to cross, means Evening or morning hours.

If above is not practical than by Air and what questions and challenges i will face thru Immigration officer and how should i prepare and handle him. What i should do and what i shouldnt? Ideally i dont want to face judge as i dont have any strong valid reason to prove that why i didnt stay 730 days. Than what is the best way to get in and stay permanently without having any fear of deportation. I am there with my family and it would be very ugly situation if i am not allowed to stay. Thanks for your kind views and support.

Best way to cross would be in a rental car carrying Canadian plates. The immigration officer may let you pass or they may give you trouble. They can not turn you away but they could possibly report you for not meeting the residency obligation. If they do, they will let you enter but you would have to make an appeal for your PR status which you will probably lose unless you have some very good reasons for why you could not meet the residency requirements.

If they let you enter without reporting you, the safe way to bring your PR back into good standing would be to stay for 2 years straight without leaving and without applying for anything from immigration. At that point, you meet the residency obligation again and can apply to renew your PR card without a problem.
