Hi,

Today , I am lucky to come across this wonderful site. I have an important issue which I will be glad if can be clarified with certainity becouse of its importance:

I visited Canada for the first time in Nov 2008 on a visit visa. Stayed there for two weeks. Then landed with my family in Nov 2008. After that i just had one visit alone in jan 2009 for one week. I have the following questions. Currently I had the chance to enroll in a fellowship program commencing july 2011. I have the following questions:

As I am working now outside Canada and do not like to loose the income I am getting, is it possible to go and live in Canada by July next year instead of November this year??

I am aware of the fact that by Nov this year, I will complete 2 years out of Canada and to obtain the Citezenship, I must stay there for 3 years out of the 5 years limit of my PR card.i.e. I should go in Nov instead of July 2011 and stay without job till then!!

I heared that , this 5 years period can be extended, provided that you stayed in Canada 2 years out of the 5 years period of the PR card??
If that is so, then if I go in July 2011, when can I get the citezenchip??

I would to like to thank you in advance for your reply, which I will hope will be soon

God bless

:(

Hi Fusasa,
I didn't get your case clearly. But in a nutshell, to apply for citizen ship you must meet ALL the following conditions:
- Be in Canada for at least 3 out of the last 4 years. (They only consider the last 4 years before your citizenship application.)
- Be a PR for at least 2 out of these 3 years.
- The period that you had stayed in Canada on a non-PR basis is counted as half. So for instance if you had been in Canada as an International student for two years, only half of it (i.e 1 year) is counted for your citizenship.

You can refere to the following CIC URL for detailes: http://services3.cic.gc.ca/rescalc/resCalcStartNew.do?&lang=en
It also has a Citizenship calculator where you can enter the dates and see whether you are eligible or not.

Hope this would be of help.
Regards,

To keep PR, you must stay 2 years out of 5 years.
To Get Citizenship of Canada, you must stay 3 out of 4 years.

Dear All:

Thank you very much for your prompt reply. I will explain in detail so that you can understand my current situation:
I landed in Nov 2008. Since then I am out of Canada

I will be joining a study course of 3 years duration in july 2011

My question is that:

Shall I go in November this year and stay in Canada, fearing to cross 2 yours out side canada
or
Go in July 2011 ( thus crossing the 2 years ) and stay there till my course is over. But by this chance I will have only 2.5 years to stay from my PR 5 years duration. I am not sure can I get extension or not!!

Can you please tell me in dates when should I go to be on the safe side.

Thank you very much

God bless

You can go in July 2011 and you will be able to keep your PR and it will be extended since you need to stay 2 years out of 5 years in order to keep your PR and get it renewed.

Dear Rocky:
Thank you very much for your reply. After going in july 2011 and staying there for 2 years:
1- Is there any chance that I might be denied extension of the PR card.
2- If I do get the extension. When will I be able to obtain the citizenchip?? July 2014??
Thanking you immensly
God bless

NO problem at all in ur case-

U can start ur study in July 2011, no need to be in Canada from this November 2010. Nothing to worry , no need for any extension.

Yes, if u stay continuously for 3 yr after July 2011 u can apply for citizenship, means after July 2014 u ll be eligible to apply.

( Nb. PR card is just a document to get out of and to enter canada without visa, u know if u ll be back in Canada even just 1 day before expiry of ur card-regardless the duration of ur previous stay, there is no authority to deport u , but after this expiry u have to get a new visa from ur country to enter canada, means with ur PR card now u ll not be able to enter, but with expired one u can only stay in Canada-if u land just 1 day before expiry date of PR card, i.e. in ur case it is Nov. 2013)

Hope it will help.

Best wishes for ur studies!
( in which university and department u got it, if u don't mind sharing)
