Am a permanent residents.my spouse lives in Canada on a work permit that expired last month but I already submitted a sponsorship(inland application) for her.we are stuck now because her employer as at d time of application let her go off her job wen her work permit expired,before then she got another job and explained everything to the new employer and they said that is cool and even sent an offer letter until today when they sent us an email and said she can only resume until she gets a work permit which we sent along with the PR application.Now we don't have the old job or the new one anymore and her work permit has expired.is there any way out of this scenario?because d waiting period to get d work permit is almost 8 months,my wife won't want to stay home for dat long doing nothing and I don't want it too.please help...any recommendations or advice will be greatly appreciated.Thanks.
 
Well, the good news is...since you DID include the Open Work Permit (OWP) WITH the Inland application, she will benefit from `implied status'. As long as CIC received your Inland application and OWP BEFORE her WP expired, she's covered.

While this may not help her with her employment situation, it will allow her to legally remain in Canada until her PR application has been processed. Oh...and the current processing time for AIP (which is when she would get the OWP) is closer to 14 months.

The only way your wife can work for a new employer before her sponsorship application has first stage approval and before she has an open work permit, is for her to find an employer who is willing to offer her a full time job and for that employer to obtain an approved LMIA. She can then apply for a closed work permit. Otherwise she will have to wait around 14 months before the open work permit will be available.
