Good day everyone.... My husband is working in Saskatchewan for almost five years. Our SINP application is in process now and waiting for the final decision. My problem is I found out that my husband is still having an affair with a married woman. I thought their illicit affair has end up. I just want to know what will be the impact in our application if I will not give our (together with my children) passport to the immigration? What will happen to his PR status as a principal applicant if our application is confirm?

Hi

Nothing will happen to him. He can change you and the kids to non-accompanying; CIC will not need your passports and you will not become PRs. He will still become a PR.

You can delay his immigration application by withholding your passports but you can not stop it.

You can withdraw yourself from the application either by stating that you are separating from him or by saying you do not want to be accompanying on his application. This will mean that once the visa you have based on his work permit expires, you can not renew it after he becomes PR and will have to leave Canada.

You may be able to withdraw your approval for the PR for the children in which case they also can not get PR. You might however not be able to leave Canada with the children because this could be seen as kidnapping but it depends on your home country being a party to the Hague agreement on custody of children.
