Hi Everybody

I need your help in understanding my situation. Please advise.

I completed my 2 year diploma course. But in the last semester i failed in one of the course.I completed that course online through Northern Alberta Institute of Technology. When i passed my institute transfered the credit.Than i applied for PGWP.They refused it that i studied online that one course. On my study permit no specific university is mentioned,There it's written "Any University".Thats why i thought that i can do online course from there.I was full time at my institute. And they gave me letter diploma and transcript which i provided to CIC.Please advise .i will be greatful for your time.Thank you

That is very unfortunate. I am sorry for you. Do you get the letter from your college state that you have graduated in the two year program? if yes, did you applied with in 90 days of your graduation date? If yes, then you should get the PGWP. I don't know how you should you proceed and what should I suggest you. May be go to good lawyer and discuss your case.

thank you canadacec :)

I am totally eligible for PGWP. What success rate you are seeing if i talk to lawyer and take it to court. Will CIC accept its mistake.thank you

Maybe get a lawyer, but don't appeal in court, which takes forever. Re-apply, if your lawyer thinks the VO made a mistake.

What is the actual reason for refusal? Can you paste it here? Also what university/college? Not every diploma or certificate is eligible, neither are all educational institutions. Only participating ones.

Any idea how long roughly it takes in court. Interestingly First time when VO refused i caught the mistake and called them and they understand their mistake they agree to review. After 2 weeks the again refused. Its confusing situation for me

Exact reason is " you failed to meet the criteria of continuous full time studies in Canada" .I studied at MacEwan University in Edmonton. My 2 year prog is fully eligible.Uni is also DLI. I studied continuous full time for 2 years.Though i failed in one subject in last semester. After failing i completed online course from NAIT.

Please advise.Thank you

While you were taking this one course online, where you a full-time student at NAIT? In universities (not sure about NAIT), one has to take 3 courses / semester to be considered a full-time student.

Get a graduation letter from School and apply with necessary documents thats all you need

did said why you are refused.

usually they say exactly what's wrong

First time they refused by saying that i didnt provide Transcript.Which i did. They admit mistake.Than second time they said its not full time studies for 2 years. My graduation letter clearly states its 2 year full time studies

I would recommend that you request your GCMS notes. Here is a link: https://atip-aiprp.apps.gc.ca/atip/welcome.do?lang=en

Now bear in mind that your GCMS request will take about 30 days to be processed. The notes will give you a better picture as to why they have refused your application. Please note that you only have 90 days from your graduation date to apply for PGWP otherwise you lose eligibility.

I think there are more details/background to this story that you are not sharing with us. I graduated from NAIT and half of my courses were completed online and I graduated with no issues and got my 3 year PGWP.

Cheers
