My wife and I are both temporary residents in Canada.
She has a study permit and I have an Open Work Permit (I am already working in a full-time position for a little more than 1 year). She will be finishing her studies on April 27 of 2023. Our visas are valid until 21th of July of 2023 (almost 3 months after her graduation)
She will be applying for the PGWP to get her Open Work Permit. Also, in order for me to be eligible for another Work Permit, she needs to have a job on NOC 0, A, or B. We also must consider the processing time of this Visa. So my concern is that 3 months in the actual scenario may not be enough time regarding processing times and to actually get a job on the NOC.
So here's our dilemma:
Once we have all the documents required for the PGWP, it may not be enough time until our visa expires for her to actually get a job on the NOC. She can apply for a PGWP once all the documents are issued by her College and have an implied status, however, I as her spouse, may have an expired work permit visa and have to wait until the PGWP process completes to get another OWP issued to me.
Summary:
- Study finishes on April 27th, 2023
- Visas expires on the 21st of July of 2023
- Time for the College to provide all documentation: Unkown. Maybe about a month?
- Time until she can get a job on the NOC: Unkown. Hopefully about 1 to 2 months
- Bottom line: The time until she gets the PGWP approved may not be enough for me to continue working, which leads me to resign from my current job and wait for another OWP issued by the PGWP.
Is this correct?
Is my status become implied as well the moment she submits for a PGWP?
If the spouse status doesn't become implied, is there a way that I can continue working on my full-time position until we wait for the PGWP to be issued?
I tried to find this specific information, but so far I couldn't find it.
