HAVE A NICE DAY! MY HUSBAND WORK IN CANADA SENCE JUNE 22 2007.RIGHT NOW WE ARE NOT IN GOOD TERM DUE TO SOME PERSONAL PROBLEM.CAN HE APPLY A PERMANENT RISDENCE ?IS HE OBLIGATED TO SUPPLY ME WITH CHILD BENEFIT AND A PERSONNAL ALLOWENCEFPR MY SELF?DO I HAVE RIGHTS TO DEMAND HIM A RIGHT SUPPORT?THANKS
 
If he applies for PR, he is not obligated to apply for your PR as well. He does have to list you as a non-accompanying dependent though as well as the child and I believe you would have to get a medical in case he wanted to sponsor you later. If you were to refuse for you and the child to have a medical you may not necessarily stop his PR application but it would prevent him from ever sponsoring you or his child for Canadian PR.

If you want him to pay child support, I think you have to divorce him first and get a child support order in your country. Then it depends on if your country has a child support agreement with Canada. Otherwise you might have to find a good lawyer and try to go after him if he will not pay.

at this time his obligation to support coz we are his legal family here in philipines either he like or not he support our need not only her daughter coz we are not in annoul yet ........................or its depend on him if he send or not so do i have right to depand support from him??? thanks

You have the right to demand support from him but you have a problem when he is in another country. Philippines authorities could say that he should pay such and such amount but if he refuses to do it, who will collect from him? There is a Canadian website about child support here: http://www.justice.gc.ca/eng/pi/sup-pen/prov/provpro.html It gives you a link to the provincial governments agencies for child support. Go to the one for the province that he lives in and contact them and ask what you need to do to make him pay child support. I think it's likely that they will ask you to file for child support in the Philippines first and send them court papers before they can do anything for you. Try this anyway.
