Hii. My name is Karthik. Me and my wife both are PR holders. Our date of landing is 09/11/2016. We lived in Toronto till Nov 29, 2017. We came back to India on Dec 1, 2017 because my mother was ill. I am still in india till today. I have now plans of going to USA as I am planning to pursue my MHA there. If I stay in India for till June and after that go to USA for the next 2 years till my MHA course completion, so after that do we both need to come to Toronto itself to stay there for straight 2yrs to apply for citizenship? Is it mandatory for us to land in Toronto again or can we go to any other place like Vancouver?

So you landed 11/2016 so you must accumulate a minimum of 24 months in Canada in the initial 5 years through to 10/2021.

Todate you have to your credit say 12 months so need another 12 months before 10/2021,

If you go to the US 6/2018 and stay in US until say 6/2020 that means that to meet your initial RO you need to stay through say 7/2021.

However as sure you are aware that after the initial 5 years the RO becomes a rolling 5 years so the time spent 11/2016-11/2017 starts to erode at each new entry into Canada so when you return in 6/2020 you need to keep this in mind for any future travel out after 10/2021.

For citizenship you need 3 years physical presence in Canada in the 5 years preceeding the application so in your case you will need to spend near 3 years post 6/2020 given the time in 2016/2017 will start to erode by the time you can apply for citizenship probably early 2022. This given with your schedule you would only accumulate say around 28 months in the country through 10/2021 but that credit from 2016/2017 starts to erode from 10/2021 onwards.

Note all dates are approximate and just for this answer but as far as the RO is concerned you should be fine as long as you stick with a return by 6/2020 or absolute latest 9 or 10/2020 and do not leave during this period. Plus keep in mind the post initial landing 5 years becomes a rolling 5 years on each entry.

Can I ask you few questions?
1. Sir, If I land in Canada by 06/2020 I should stay there till 06/2021 and if I don't travel anywhere during that period that will add upto 12 months, right?

2. So from 11/2016 to 11/2017 ie 12 months. In total I have 24 months as credit. Will that be counted for 2/5 stay?

3. To apply for Citizenship I need to stay in Canada for 1095 days (36 months), not straight but my stay should add upto 3yrs?

4. If I don't leave Canada till 06/2022 after landing in 06/2020, can I apply for citizenship?

Please Correct me if I am wrong.

5. If I do my MHA course of 2 years from Canada, finish the course by 06/2020, can I apply for Citizenship in late 2020?

6. If by chance I do happen to get the citizenship, for long can I stay out of Canada? Is there any expiry for citizenship?
7.I am planning to renounce my spouse's PR as she is unable to travel with me, am i taking a good decision?
