Hi guys,

I have a PR status situation that unfortunately I've not been able to figure out via the normal CIC help topics.

I am British and a few years ago married my Canadian wife and applied for permanent residency, this was in 2016 and was granted in 2017. At the time we were living in England, and have done ever since, although we do intend on returning next year.

My wife is being offered a Job promotion and it looks like we would want to stay another year in England, which would ultimately mean I would not have lived in Canada 2 out of 5 years.

What would you advise I do? I've read I can end My PR status early, would this make sense for re-applying before going back? Would it be better to wait till I'm back in Canada next year and appeal in some way at the point of renewal?

This situation has gotten my wife quite nervous about the future, so any advice would be appreciated.

Not meeting your residency obligations can lead to revocation of your PR status, yes. However, there are many cases of people being allowed in even if they would not be able to meet the RO.

Let's say your PR card expires in December 2022. You attempt to reenter Canada in March 2021. The odds of you being allowed in are quite high, especially since your wife is a citizen and you will indicate your desire to settle permanently in Canada. Once you're in, you stay put for two years and you will have maintained your RO.

OTOH, if you arrive in October 2022, the officer is likely to ask a lot more questions.

My PR status was established on the 24th of august 2017, my PR card says its expires on the 5th of October 2022.

As the situation stands now, we will likely re-enter Canada just before Christmas next year.

I must have accrued 2 weeks in Canada since receiving PR status because my wife wanted to stay in England longer.

Once we go back, we would likely be there for many years, maybe forever, so would it be the case that I would only need to prove my PR status if I were to renew my PR card?

Would I be allowed back in with only 10 months left on my PR card?
