My PR application(FSW) was rejected recently. The immigration officer in the refusal letter states that the work experience letter obtained from the employers doesn't contain information about job responsibilities and duties. I agree that this was my mistake. However, instead of requesting for more information like they did for my police certificate and bank statements, they rejected my application instead.

My application was in their system since February of 2021. So, it is quite frustrating to say the least and a very harsh decision.

My IELTS expires in October of this year. So, I'm not sure if creating a new application would help me in any way since the FSW PR draws haven't started yet.

Is it even worth appealing against this rejection? If so, what immigration law firms would you recommend?

I am based in the US.

It's normal for applications to be refused if the job letter doesn't meet requirements (and without IRCC requesting more information). It's very important to make sure applications are complete when they are submitted for this reason.

Can you obtain a new letter from your employer that does meet the requirements asap? If so, get the letter, request reconsideration (via webform) and submit the new letter to IRCC. Chances are definitely on the low side they will reconsider but it's worth trying.

IMO an appeal doesn't make sense since the error was on your end (not IRCC's) and your letter didn't meet the requirements.

Where you are based is irrelevant to this situation.

FSW draws are going to restart in July. What's your score? Normally in these scenarios the advice is that you're out of luck since your application was incomplete and the next step is to create a new EE profile and wait for ITA again.

Thank you for the reply. I will do what you suggested.

My CRS score is 475.

Though there is another issue if I decide to restart the process immediately and create a new EE profile.

My IELTS expires in October, 2022. If I do submit the application will I be rejected again if the FSW draw happens after October, 2022?

Hmmm... Hard to say how soon you will be selected when draws restart. Scores are expect to be about 500 at the start and it's really unknown how rapidly they will drop.

I would re-write IELTS now. There is absolutely no guarantee you'll be selected by October and your IELTS score must be valid at the time you submit yoru complete application (post ITA).

I don't understand your last question. If you're asking about your IELTS results expiring, these must be valid at the time you submit your application (again, that's post ITA) or you'll be automatically refused. That's why I'm recommending you re-write IELTS now.
