Hi there,

Excuse me, I got a question about the application according to the situation of my family:

We would like the sponsor the family to come over to Canada, the main reason is helping my brother who is 10 years old, to come over for better education.

However, our income doesn't meet the minimum income for the immigrant of family, we can meet the requirements of parents visa.
Can my parents bring my brother over together as he is a dependent?
Would they be able to have the open work permit then?

On the other hand, would it work if I be the custodian for my brother?
But as I know about the study visa, CIC can reject to extend it. We prefer if he can finish the secondary school study here rather than sometimes in a short term.


I am sorry as my story is quite long and complex. Hope I can get some ideas and experience sharing and recommendations please.

Only your parents can come here on a super visa. No - your brother cannot be included as a dependent on the super visa. No - your parents will not qualify for an open work permit if the are here on a super visa.

You can bring your brother here on a study permit if you wish him to attend school. Note that you will have to pay international student fees to have him attend public school. This will cost approximately $15,000 per year.

As my husband is operating a business here, is there any chances that he can help my dad getting a work permit, like being a driver for the company?


But is it only 2 years permit everytime, is it common to be rejected for extension?

And what is the different if my brother apply for the permit with me or not??

There's really no chance your father will be able to get a work permit. In order to do this, your husband would need to obtain an approved LMIA. To obtain an approved LMIA, your husband would have to advertise the role for at least a month across three different locations (which will cost your husband a lot of money) to prove no Canadian could be hired for the role. Your husband would then have to submit the LMIA application for approval which will take around four months - and there's no guarantee of approval. I don't think there's any chance an LMIA is going to be approved for driver - anyone can do that job and there's no way your husband is going to be able to prove that no Canadian could be hired for this role.

The right path is to sponsor them through the parent / grandparent immigration stream. However in order to do that, you must show that you meet the income requirements to support them so that they won't become a burden on Canada's social care systems.

Again, you are also free to bring your brother here on a study permit. However you need to be prepared to pay international student fees.
