Hello, I sponsored my parents back in 2009. In Dec 2011, they were asked to submit original docs, passport, and medical requirements. My father was asked to re-do XRay and Mental status exam. Last medical submitted was May 2012. Since then we have not heard anything until yesterday, Feb 20 2014, when my parents received a call from the Cdn Immigration Medical Officer requesting my father to return and re-take XRay and Neuro test. Now my father has Alzheimer's. I feel that my father will not pass medical and will be rejected. I still want for my mother to come so I can get her PR card. I called embassy and they said that I cannot take my father off from sponsorship. SHould they not have completed processing right after the medical was finished. Not sure if there was a neglect there by the immigration office of not reviewing and making decision after all medical was completed. Please give your opinion. Should I cancel my sponsorship. SHould I continue with the medical and let them decide if it is inadmissible, and then make an appeal with the Immigration Board. Please advise, I am confused, want to do what is best for them.

You have nothing to lose by keeping the application open. If he fails the medical, and is ultimately refused, both parents will be refused together. Trying to go down the "negligence" path will lead you nowhere. The delay may well have been due to other factors that are unrelated to medical results. It's also possible that they suspected that there might be a long term medical issue and wanted to wait for a period to see how it progressed. Order your GCMS notes for more details.

Meds expires in 1 year and if the process isn't over, they are asked to do red-meds and this is pretty common. You are unfortunately victim of bad luck and timing, however having an illness doesn't necessarily refuse your fathers app - do the meds and let the doctors send their report, and wait for them to respond. Regardless of your father being on the app even before the sponsorship, him being sick ( if admissible due to health grounds ) would have refused your mothers app anyways ( since all family members have to pass meds regardless of them coming to Canada or not ). The only way you can sponsor single parent is if they are divorced

If they refuse the app due to meds, then you can appeal with plea to pay for meds cost etc, very tough and rare to win but no other option

See parents thread for more cases and help

Hi Jouiver,
I had similar situation. CIC asked me for medical furtherance (mental assessment of a child). I did the test and the doctor sent the results since Sep 2012. No news am waiting. Very bad long time waiting.
I think your case is easier as section 38 (c) might does not apply on sponsor ship, check this. If it does not apply, then don't worry as long your father sickness dose not transferable to public and he is not danger to public.
If it does apply, and he fund might inadmissible, They will send you and give you chance to submit a plane (called fairness letter).
Hope the best.

Thank you everyone for your replies. It made things clearer. I think I will proceed as planned and just leave it to God's will. I don't have the heart to take my Dad off the sponsorship (if it were possible), but I also don't want my mom to lose the opportunity.

His father's illness also cannot create a burden on Canadian health care and social care system. This is a requirement that spousal sponsorship and dependent children are exempt from. But it applies to parents. This is why the OP is worried.

Juvier - Why don't you go ahead and see what happens? Like everyone has explained, it's not possible to remove your father from the application. Either both of your parents are approved or neither. You've gotten this far. I would re-do the medical and see what happens.

Yes, the decision is for us to proceed with the medical. Thank you everyone for the replies.

Hi. I am curious to know what happened to your parents case since father had medical issue. I have same scenario. My parents got medical exam letter. My father is totally bed ridden. What is the scope????

Unfortunately both of your parents have to take the medical and pass the medical. There's no way around this.
